Kenneth Gohmann, an Illinois resident, was discovered by police officers unconscious in his vehicle, which had been left in drive. The incident was captured on the responding officers’ bodycam footage, providing a detailed account of the encounter. Upon arriving at the scene, the officers approached Gohmann’s vehicle and attempted to wake him. After successfully rousing him from his unconscious state, the police asked Gohmann to step out of the vehicle and perform a series of field sobriety tests to assess his level of impairment.

Throughout the administration of the field sobriety tests, the officers carefully observed Gohmann’s behavior, balance, and ability to follow instructions. Based on their observations and Gohmann’s performance during the tests, the police formed the belief that he was operating his vehicle while under the influence of alcohol or drugs. As a result of their assessment, the officers made the decision to place Gohmann under arrest for driving under the influence (DUI).

Watch out Mother's Against Drunk Driving, there is a Federal bill in the Senate coming up this next session which will decriminalize a first-time DUI offender if they have not reoffended and drank and drove and got caught in the 10 year post conviction period. They will automatically get pardoned from their DUI criminal conviction.
This follows similar laws which have been passed in European states as well as a pending law in Canada that will remove a drunk driving restriction from the criminal record of people who have been convicted of a drinking and driving offence but did not reoffend and did not get reconvicted for another offense.

I’ve been retired for 20 years but while a was still working there was a case in Florida in which an intoxicated person knew he shouldn’t drive. So he got into the passenger front seat and threw his keys into the back seat. An officer arrested him for DUI. Florida statute chapter 316 defines a driver as “Any person who drives or is in actual physical control of a vehicle on a highway or who is exercising control of a vehicle….” I don’t know what happened with the case but I would not have arrested someone who made sure they weren’t going to drive by having the keys out of reach.
