One year ago, 17-year-old Brendan Depa was arrested after he attacked a teacher’s aide at a Florida high school. Depa’s family is now speaking out after the incident as those close to him say, “he isn’t a criminal.” The shocking incident took place after the teacher’s aide, Joan Naydich, allegedly took away his Nintendo Switch, causing him to lash out at her. Naydich suffered numerous serious injuries due to the attack. Depa now faces up to 30 years behind bars. Law&Crime’s Sierra Gillespie speaks to the boy’s family about the incident a year later.

Kids used to learn this behavior was bad because they would get beat up at the playground. These parents enabled him and that led to this.
Hes faking all this special needs stuff to get a check fraudulently and his mom is in on it
I hate this guy as much as anybody, but part of this is a curriculum thst wants him to obey without tesching him anything he perceives as valuable or otherwise engaging him. Counseling that teaches why learning life skills is important would have helped, even if it took years.
But also because, I'm not a doctor BUT HIS COMMENT TO THE POLICE OFFICER ALSO MAKES IT VERY EVIDENT THAT HE'S JUST A CHILD.
I've seen the real video. And as a man who has been involved in several different types of combative sports, I will say that the person hitting the teacher appears to be an angry adult. But that's physically. When I look at it from a psychological point of view, IT'S VERY EVIDENT THAT THE PERSON HITTING THE TEACHER WAS A KID; BASED ON THE FACT THAT KIDS HIT ADULT DIFFERENTLY THAN ADULTS HIT ADULTS.
This kid does not understand and he will never fully understand what he did. It is not right for him to be in jail, he is not a risk to himself or others, he has a developmental disability. We know he did wrong. He does not think like us, he does not process like us. It is not his fault. I hope this boy gets a better group of people to advocate for him.

I used to be in special education thats what they called it when i went to school and some kids, mostly boys went to juvinal hall in those classes so i had violent kids in my class as well. They never hurt anybody but one kid in junior high school got so mad he would punch glass windows thats what i had to be in classes with.
Parents are 100% to blame. The mom couldn’t even care less what happened to the women.

Why did the parents let him take a toy to school instead of going to learn something…they were using the school as a day care
The Karen brought this upon herself. They were warned to not take his switch away but she did it anyway. I feel no pity for her
I don’t doubt these events are heartbreaking for his family and care providers or that his medical conditions at least contributed to his actions, but that does not exempt this young man from the entire legal system. As a defendant, he has the absolute right to fair trial, which includes understanding the proceedings and assisting his defense. He cannot be prosecuted unless he is found to be legally competent to stand trial. If he is found competent, then he has still has the right to plead not guilty based on mental illness. He has the right to attorney and must be afforded the opportunity to present evidence and testimony on the issue of competence and/or a defense based on mental illness. I’m not sure there is a way to allow this case to circumvent the court system, where the decisions are made by a judge and a jury, that would as or more just for the defendant and the victim.
A disability is not a free pass to be evil.

Those "parents" should not attempt to adopt or "raise" anymore kids.
He gets 5 years in prison and 15 years probation. And this outraged a lot of people since many wanted him in for 30 years or even put to sleep for attacking the teacher and his mom prosecuted
The kid is autistic. That switch was probably the only thing keeping him centered and sane….and she took it. She either didn't know or didn't care.
That's the reality with dealing with autistic kids that are strong.
This trash needs 10 years in prison a d pay the victims medical bills and fined $10,000.

I’m an ABA & this is why the students that I work with are elementary age based. I refuse to work with teens or adults that have intellectual disabilities. Because of situations like this. All of these “triggers”. Well why allow him to use electronic devices so much that he feels he can’t go 5 minutes without it????😮 & Sadly there are so many ABA vacancies for high school students. Not worth it at all!

I don’t condone what he did. If the parents laid out what not to do in the IEP then it shows that the school system failed him. What ever teacher that would be interacting with him should have been trained on his IEP. This type of thing is too common. It’s also sad that they took him off of his medication cold turkey. That will do more harm than help. Again, what he did is definitely not acceptable behavior. What they are doing to him is more harm than benefit. He has to understand the actions he took part in. What you may understand it as is perceived completely different by him.

Thats why you should not mix students with special needs with others, is not discrimination, is a situation to put equals with equuals and also to treat students with their special needs
We screwed up when we got rid of most mental hospitals, especially long term facilities. I know they were horrible places, they should have been fixed not abandoned.

Thos was a situation where yes, its terrible that happened but hes obviously just a big kid who needs someone with him at all times as hes sadly not all there. There should be alterior methods for those with such a disability. Its heartbreaking. Hope the teacher is ok but thats still sad how we handle things for mentally ill people
