On March 12, 2022, in the afternoon near Racetrack Road and Mar Walt Drive, Okaloosa County Sheriff’s deputies stopped a black Dodge Charger for having overly dark tinted windows. The vehicle, occupied by the driver and a 17-year-old passenger named Darius Wingate, was initially pulled over for a routine check. Upon requesting identification, Wingate claimed not to have any, leading to suspicion when the name he provided did not match any records in Florida’s license database, suggesting he might have given a false name. The driver received a warning, while closer attention was focused on Wingate.

  3. One tool that could help that LEO's should be issued to each individual officer or patrol unit is a Portable Digital Fingerprint Scanner.
    It would be utilized once it's been established that a false/fictitious name or refusal to give a proper name for identification has occurred.

  4. is it really constitutional to stop a car for tint which is the new way to make a shakedown for officers but to have to take the ID of the passenger for a car that has the wrong tint how is that constitutional?

  9. I just checked Florida law. Police in Florida do NOT have the right to demand the ID of a car passenger
    UNLESS they have reasonable suspicion the passenger committed or is planning to commit a crime.

    Clearly, the officer had no basis to suspect the passenger of this when he asked for his ID.

    was for the car having dark tinted windows?

    It seems like this was a pretextual stop by the cop.
