An Austin police officer will not face charges for the fatal shooting of a car burglary suspect last April who shot him. The Travis County District Attorney’s Office says a grand jury made the decision Wednesday. The shooting happened Sunday, April 3, just after 11 a.m. in a parking lot in the 500 block of West Avenue. Darrin Martin, 25, had been spotted burglarizing vehicles in a parking garage at the Austin City Lofts on 5th Street, police say.

Officer Armando Perez was on routine downtown patrol when he saw the concierge of the apartment building running after Martin. Officer Perez caught up to the men where he witnessed the two men scuffling in the Frank and Angie’s Pizzeria parking lot on West Avenue, investigators say. The concierge explained what was happening and when Officer Perez attempting to handcuff Martin he pulled a gun and shot Officer Perez in the lower torso, beneath his bullet resistant vest. Officer Perez then returned fire and shot and killed Martin, police say.

Officer Perez is still recovering from his injuries but has returned to patrol duties. Martin was a suspect in several vehicle burglaries and thefts in San Marcos, according to San Marcos police. Approximately 30 burglaries in San Marcos match crimes in which Martin was involved, including credit cards, cash, weapons, and other items being taken from unlocked vehicles.
