Went out and recorded with Katman and Daniel, I was excited to see him, and he had a mic for me to test out.
So this time at the checkpoint, they suddenly were letting people turn away from the checkpoint, it was a miracle- Katman left, Daniel and I walked back to the checkpoint and wouldn’t you know, they were back to pulling people over so we caught up to one of the stops.

I'm firmly against the checkpoint. I have been hit twice by drunk drivers and have arthritis in my spine as a result. I didn't see them pass by any checkpoints. If I call 911 to report a drunk driver it takes the police 10 to 20 minutes to show up if they do.
The case law TZ was trying to remember is The City of Indianapolis Indiana v. Edmonds. It establishes that ID checkpoints are illegal but DUI checkpoints are legal because the purpose they serve are for public safety and not for infringing on someone's right to travel freely as guaranteed under the 4th Amendment.
I disagree with the judge's opinion because if it's only to check if the driver is impaired, then why ask for identification, proof of insurance and registration? I guess that is one of the famous "loopholes" that even Supreme Court judges like to leave in.

The police are under no obligation to tell you where they are going to book a suspect.
Another incorrect conclusion by your pal, Soulman. It doesn't matter how far a person drives or what he thinks the intent was. The law states that no person who is under the influence of an alcholic beverage or drugs (illegal or prescription) will not operate a motor vehicle while under the influence of said substances…..period. It doesn't matter if he/she was only moving the car a short distance.

Soulman needs to get his terminology right. It isn't a "minor violation." A violation of your Constitutional rights is a violation no matter how "little" it is. What a judge determines is the intrusion level of a check point. The intrusion level is minimal and if a person is sober, is only contacted for a matter of seconds then released. An intoxicated person, when contacted, will have objective signs of intoxication (blood shot, watery eyes, slurred speech and/or an odor of an alcoholic beverage). From that initial contact that was considered a minimal intrusion, there is now probable cause to believe the person is under the influence of some type of intoxicating substance. For the safety of the general public, that minimal intrusion led to the detection of an intoxicated driver. Also, no judge is going to say that a practice is a violation of your rights but it's a small one so he/she is going to let it go. Hopefully this helps.
Where does your pal, Soulman, get his information???? If checkpoints were a violation of the 4th Amendment (unreasonable searches and seizures) they couldn't be set up and even if they were set up, any evidence of DUI would be considered tainted. Find out how many people arrested at checkpoints for DUI had their arrests vacated and their licenses returned. But if the DUI convictions were upheld and the initial contact through the checkpoints were deemed of no or minimal intrusion, then Soulman is wrong. I have seen that he and your other friend Katman tend to inject their opinions a lot and try to make it look like fact. As I pointed out to you in an earlier blog, your friend Katman was wrong about DUI's with bicycles.

driving is a right and not a privilege. you earn that right by passing a drivers test.
To all those opposed to people invoking their rights against warrant-less searches and use the argument "It's keeping the public safe and taking drunk drivers off the road!" That's untrue. According to Levy Country Sheriffs press release page, out of the 89 vehicles passed through, 17 were detained for violations, only four of which received citations and three were arrested. Two were arrested for driving under the influence of cannabis and one was arrested for possession of cannabis. NO alcohol DUI related charges. What does that tell you, if they are conducting alcohol DUI checkpoints yet nobody was was cited for related violations. It's all a money grab folks. No victim, no crime. If Levy Country was so concerned about people driving drunk and the safety of the public, they would offer free public transit within the county during New Years.

Checkpoints are revenue generating stations to find any potential violation that carries a fine!!! Good for corrupt officers to stack up easy or sleazy overtime! There best paydays come from civil asset forfeitures and from prison time with those annual bonuses to the departments from appreciative prison owners!!!
Check points are useless tools to hurt the poor no matter what color they are ,then again some police officers get off telling people what to do that are minding their own business ,let the cop reversed the situation putting him on the street and then see how he feels if he was stopped for no reason.

I don't understand the cops have a breath tester it could be over in a minute or two but they want you to do all the jumping through hoops first, then try the breath test??????????? the tester would be a lot quicker
