Aggravated Murder: The Case of Brandon Stonum – Everything Law and Order Blog

On May 24, 2019, Brandon Stonum was arrested after discharging his legally-owned firearm in what he claimed was self-defense. Shortly thereafter, Stonum was charged with one count of aggravated murder. He was granted bond. Sort-of…

Stonum’s bond amount? Three-quarters of a million dollars.

Stonum’s privately retained attorney, Andy Petropouleas, filed a motion requesting that Stonum’s bond be reduced to $100,000. He argued that

1. Stonum had no felony record.

2. He had lived in Cleveland his entire life, and had close family connections there.

3. He held a concealed carry license and had been in lawful possession of his weapon on the day of the offense, and

4. The case involved an alleged robbery, in which Stonum claimed that he had fired in self-defense. Immediately after the incident, Stonum called 911 and requested medical attention for the individual, and while on the 911 call he observed a police officer and flagged him down for assistance. Stonum had been cooperative with law enforcement the entire time.

On June 18, 2019, Judge John J. Russo granted Stonum’s motion for reduction of bond, over the State’s objection. Stonum’s bond was reduced to $200,000, with GPS monitoring. But the restriction wouldn’t last long.

On June 21, 2019, Cuyahoga County Prosecuting Attorney Mike O’Malley filed a motion to terminate charges. The case against Brandon Stonum was dismissed.

This is the police interview of Brandon Stonum.

  1. You put yourself in a bad situation. Buying drugs from unknowns is a really bad idea. You’ve got to be smarter than that. If you “must” buy illicit drugs. Get them from a homie. To be honest. You should have gone to CVS got some Oral gel. The next morning become a walk-in at the dentist office. You’re prior or lack there of record,is your saving grace. If you’re record had any scratches on it. This turns out a lot different. The fact that you obtained a CCW gave you the benefit of the doubt. Use your head next go around. Carry on young Jedi.

  2. The police are not your friends, they are not on your side, and they don't care what happens to you. Once you've been placed under arrest, that means they don't believe your side of the story, they're going to shape the evidence to support your guilt, and you will not be able to explain those cuffs off. Shut up and demand an attorney.

  3. This is one of those cases you don't want to b involved in. Especially if you are completely innocent.

  4. The police are working for the "victim" and their family in that room. They are looking for every opportunity possible to place blame and convict.
I am not a cop hater. These are just simple facts that we all should know by now.

  5. I would love to see a video explaining how you acquire content because like this it didn't involve any public figures and wasn't "high profile" and really wasn't even that "newsworthy" so I'd be interested in what led you to request this footage.

  6. You just signed your life away talking to them…Too hard to watch 15 mins in cos those dumb cops gonna look smart when they not…Pfft

  7. Glad they dropped the charges this cud of gone bad really bad for cuz so bad he might have never came home. Think these detectives were already thinking he was guilty

  8. He's really messing up trusting investigators, there job is to get a confession or enough self incriminating evidence without a lawyer present. He's being educated and don't know it.

  9. Why are you talking? Why are you signing things? Look, I live in another country and can totally prove I did nothing. Yet I STILL would demand a lawyer and then shut up. Shut up means stop talking. Do not say Hi. Do not answer when they say how are you. Don't comment how the room is cold. Say "I wish to invoke my right to remain silent and I want a lawyer". That's it. For the love of God WHY ARE YOU SIGNING PAPERWORK!!! Close your mouth, fold your hands, shut your eyes and try to nap.

  10. I was certain this was going to go another way, just based on the accusatory way the police questioned him. Stonum is relating the incident and the cops are interrupting with incredulous questions and comments. Their agenda towards an arrest was obvious.

  11. it is like they were trying to get him to twist his story. i have my ccw and i don't think i would say shit until my lawyer came

  12. I could tell by the thumbnail this was Cleveland by the interrogation room from all the first 48 episodes I watched haha

  13. The only thing you ever say to those motherfuckers is “lawyer”…. i’m sorry is my lawyer in the room because you seem to be talking to me get me my lawyer that’s it you say nothing ever.!!!!

  14. These cops want this man convicted. You have the right to protect yourself. Do anything it takes to live. These cops should be fired. They are just wrong. The guy should have just dumped that guy in the swamp and gone home. That way he wouldn’t have to tell the cops.

  15. Always delete the dick pics or' "self porno's' from your phone before you go killing people and shit. Detective Fishbot must have had a good giggle going through Brandon's phone

  16. When there are serious charges (anything above infraction level) in prospect, you want a lawyer. End of story.

But when you already know you're looking at an affirmative defense like self-defense, an attorney is TOTALLY MANDATORY.

Affirmative defenses (defenses in which you don't deny the act but argue that the act was legally justified) are tricky things with very strict legal standards — and the burden of proof is on the defense. A wrong move in the interview room can weaken or even nuke your self-defense arguments.

No matter how 'obvious' it is to you that you were fully in the right, YOU NEED A LAWYER TO ARGUE THAT!

Also, you can't dodge it; you must accept that you'll be arrested pending that determination. Seems unjust, sure, but that keeps the investigation that your defense rides on beyond question. Your acquittal or vindication has to go through the process.

  17. LAWYER!!…I KNOW ITS SCARY, I KNOW YOU FEEL MAYBE IF I JUST TELL THE POLICE MY SIDE THEY WILL LET ME GO. I KNOW IF YOU ASK FOR A LAWYER YOU WILL UPSET THE POLICE AND THEY MAY THINK YOUR GUILTY….THEY THINK YOUR GUILTY ANYWAYS..STAY QUIET ASK FOR A LAWYER. THERE IS SO MUCH SHIT GOING ON IN THE LEGAL SYSTEM, THAT IS WHY THEY SPEND MANY MANY YEARS STUDYING THE LAW

  18. This is why you should have self-defense liability coverage if you have a CCW permit. You'll have access to an attorney who specializes in self-defense cases. I treat it just like my firearm in that I would rather have it and not need it than to need it and not have it.

  19. Listen to these asshole cops trying to confuse him about the streets he said he was taking. They're doing everything they can to make it seem like he's lying, trying to get him to say something that they can later say "Look, he was lying about where he was driving, he's obviously guilty." Disgraceful.

  20. My CCW instructor warned us that 2 things will be sure to happen if involved in any self-defense shooting:
    1) You will certainly be arrested.
    2) NEVER talk without an attorney!

  21. Damn they wouldn't even let him tell his story. They keep trying to tell him what did, which way he went. Then the cop had the audacity to ask him why the dead guy didn't reach for his gun. How the hell he suppose to read somebody 's mind

  22. Cops kill in self defense and go home and get a metals 😂 but a citizen is wrong until proven guilty

  23. And the moral of the story is, go to your dentist regularly! If it werent for that toothache he never would had gotten himself into a situation where someone ends up getting shot and kill! Get that dental ins folks!

  24. I love our LEOs, but never talk without an attorney. You could be facing a DA who hates guns and gun owners. You never know the intentions of individuals you have never met. Look at how they tried to convict Klye Rittenhouse because the DA hates people being able to defend themselves.
In this case he is lucky he didn't get charged since this was technically a shooting during a fellony. I believe his is attempting to purchase the Percocet made his carrying a concealed weapon illegal.
I hate the way some politicians and DA's try to use the law against ordinary people. I welcome any constructive criticism.

  25. Detectives are not just fact gatherers. They are certified paid coercionist that try to get convictions and people to admit to doing things wrong.
