  1. I have no tolerance for someone who intentionally entered our country illegally, especially when they have illegal firearms. I’m all for having firearms but have no patience for criminals having illegal firearms.

    I cannot imagine sneaking or breaking into Italy, using their tax payers’ money in order to live, attain illegal goods, then have the gall to sue the country (the Italian people) for millions of dollars because my spouse was shot by the police there. I would also understand that I am not Italian and I would not expect the have the same rights as Italians.

  2. On the wrong address thing. I deliver food and I'm dyslexic so for me it's easy to go to the wrong place. But I'm not showing up with guns blazing either. So no harm no foul.

  4. If you ever find yourself having a jury deciding your fate. Don't count on them being responsible. They judge by feelings not what the law is. Proof? They don't need proof. They just need a good story. The best lawyers are good story tellers. Nothing more.

  6. Everyone in the U.S. should be treated as if they have rights. If we don't, then everywhere interaction with law enforcement will start with people having to prove citizenship. Police will take that too far

  9. This is exactly why you should never say that the Constitution grants you rights. It does not. It recognizes certain human rights, and gives them legal protection. It does not create them, it does not grant them, it only recognizes them, imperfectly.

  10. I’ve been reading comments about rights, and I don’t think the link between government, civil rights, and Rights endowed by our Creator are well understood. The right to Life, Liberty, and the Pursuit of Happiness are universal rights and have nothing to do with citizenship nor country. Mexicans have the right to Life regardless of immigration status. Rights listed in the Bill of Rights are those which the US Government is prohibited from interfering with pertaining to citizens. They don’t pertain to Mexicans on US soil illegally.

    The constitutional limitations on government still apply to any and all government agents regardless of time place and manner.
    We cannot allow those who act on behalf of the constitution to interpret the constitution as anything less than the sole origin of their authority.
    The fourteenth amendment might read as applying to states but the State would have no argument whatsoever to claim the federal government has power the states do not and those powers originate outside of the constitution.
    No state shall deprive ANY PERSON, of LIFE, LIBERTY or PROPERTY, without due process of the law.

    Do we wear some badge, insignia or tattoo saying we are a citizen? How would it ever be possible to identify between a citizen and non citizen on sight?
    We cannot. And we do not pretend our laws only apply to certain people's. Our laws apply to any person within the jurisdiction not that law.

    The biggest counter to the states claim is simple. If they have no rights they have no obligation to follow our laws, respect our government or respect our rights.
    You have rights only if everyone else has the same. Take from one, take from all.

    It is possible the shooting might still be found within policy regardless of the citizen/rights argument.
    It is a shame the two issues get conflated as one.
    Do you have the right to kill a person who is not a citizen?
    Nope, it's still murder.
    Our rights are natural and from the very beginning of this Nation we have recognized some eternal truths and fundamental principles.

    The United States of America was founded by The Declaration of Independence not The Constitution.
    The Constitution was the framework of government placed upon the foundation of principles, rights and interest essential to individual freedom.
    We hold these truths to be self evident. That all men are created equal and bestowed by their creator with certain inalienable rights, chief among these life, liberty and the pursuit of Happiness.
    These are the founding principles of the nation. Notice it says nothing about citizenship, religion, race or gender. All men are created equal, all rights are equal.
    The privileges of citizenship are privileges not rights.
    If the jury used the citizenship argument they should be charged with deprivation of rights under color of law. The jurors were acting under color of law, as representatives of the people and bound by the laws and constitution of the land.
    Their individual decisions aside, they are personally responsible and liable for their own conduct and should be held as such.
    To prevent putting juries in a position where they are liable. The judge should have declared a mistrial as soon as the state presented such a ridiculous, unlawful, unconstitutional claim as legal argument.
    The judge can throw it out but he cannot erase it from the minds of the jurors.
    This is not a novel legal theory never attempted before. The 14th amendment addresses this issue as it has been raised numerous times prior to the drafting of the 14th amendment July, 1868.
    This issue is not a question, not a legal theory and should put the prosecution individually liable for even attempting to bias the jury in this way, deprive a person of their rights under color of law.
    And the prosecutors should be charged with conspiracy to deprive resulting in death which would result in both the officers and the prosecutors facing the death penalty.
    I'm betting if the system actually worked impartially and equally, just charging these traitors would prevent anyone trying this crap for another 170 years.

    Might want to highlight the opposing counsel on this one. How they managed to lose this case and not drive home to the jury equal protection, equal rights for all, is embarrassingly incompetent.

    But let's be honest as well. The state has nearly unlimited resources, they run the court and the law. It cost money to get the best jury, the best lawyers and present the best case.

    And finally, the judge should be imprisoned as well. The judge reserves the power and ability to end this. Declare a mistrial or even invalidate a verdict of guilt. He failed us all by presiding over a travesty of injustice and did nothing to prevent it happening again.

    It's a decent system on paper, in reality it isn't working.

  16. Common sense, really. Rights are for American citizens, here in the USA. Foreigners without legal status are not entitled to that which legal citizens possess.

  17. The constitution ensures that all people within our borders have rights. Those rights may not include voting or other rights contingent on citizenship, but you always have a right to life. We would be angry if an American citizen was shot or beaten by police in France if he had overstayed his visa.

  18. The United States constitution only applies to American citizens. Illegal aliens are no different than escaped convicts. However human rights like life and liberty are universal. So while I have no problem with the police dragging his ass out and deporting him, they need to have the warrant to go into the house to get him first. And how the hell does an invader without any credentials to his real identity gain own property it America? I think the Mississippi jury is covering up murder for the police, but they’re also telling these illegals get the fuck out.
