Rochester, N.Y. — On Sunday, December 24, around 8:30 a.m. the Rochester Police responded to a 911 call about two men, one with a gun, walking on Murray Street toward Lyell Avenue. The first officer can be seen talking to three people on a sidewalk, explaining that police had gotten calls. Another police car shows up. One of the men – identified as 46-year-old Todd Novick, moves a few feet down the sidewalk.
The officer tells dispatch that Novick is running northbound before yelling twice to stop and once to drop the gun. Five shots in quick succession are fired immediately after the command from the officer and the replica gun is seen clearly as it falls to the ground. Novick then follows directions to roll onto his stomach and put his hands behind his back after being shot. Police began emergency medical aid until ambulance crews and the Rochester Fire Department arrived. Novick was taken to Strong Hospital where he died.

There was a day where I would have called this murder but we live in a day where so many of these young men, boys are running around with illegal firearms and not afraid to shoot at anyone. If your running and you pull out a gun and you get shot in the back well you got shot before you had a chance to turn around and shoot and if it was a fake gun then your a moron for even running. You can have a fake gun as long as you don’t use it in a crime.

That escalated really quickly. What’s tragic is if the man would have stayed there, got searched and they found the fake gun, he probably wouldn’t have gotten arrested at all. Because it’s not illegal to possess a gun that isn’t real, not even if you are a felon. Maybe they find some other charge to get him off the street, but it isn’t going to be possession of a firearm because it’s not really a firearm. It doesn’t fire and isn’t designed to fire.
