San Antonio Police Officer Fatally Shoots Man During Traffic Altercation – Everything Law and Order Blog

San Antonio, Texas — On January 18, 2024, two San Antonio Police Officers, riding in the same marked patrol vehicle, conducted a traffic stop for a traffic violation at 700 block of Southcross. One officer contacted the driver, 42-year-old Jervon Harper and asked him to step out of the vehicle after smelling the odor of marijuana coming from inside the vehicle. Harper refused and began to physically fight with the officers as the officers attempted to detain him. During the struggle, one officer observed the suspect with a handgun. Both officers pulled out their duty weapons and one officer fired a single round at Harper, striking him. Harper was transported to a local hospital where he was later pronounced deceased. Officer Edgardo Valladares, who discharged his weapon during the incident, has been placed on administrative duty pending further investigation. Valladares, a three-year veteran of the force, will remain on administrative duty until the completion of the inquiry.

  2. The Supreme Court of Pennsylvania recently held that the smell of marijuana alone does not provide an officer with reasonable suspicion to conduct a search. See Commonwealth v. Barr, 266 A.3d 25 (Pa. 2021). The Barr court based its holding largely on the state legislature’s enactment of the Medical Marijuana Act, which legalized the use of marijuana in limited circumstances. Similarly, the Supreme Court of Delaware recently held that the smell of marijuana alone does not provide probable cause to arrest a juvenile. See Juliano v. State, 260 A.3d 619 (Del. 2021). In its decision, the Juliano court discussed how its prior caselaw on the issue predated the State General Assembly’s decriminalization of an ounce or less of marijuana. These state supreme court decisions are two among other state-court decisions retreating from caselaw holding that the smell of marijuana alone can support a warrantless search. Rhode Island and Colorado have seen similar caselaw developments.

  7. One word "comply" get a ticket and go home or make a quick stop at the Jail and get your "get out of free card" so many stupid people doing stupid things..they keep thinking the Police will let them go because they are screaming and fighting like a rabid Banshee….nope and nope.
