One of the Graham Factors states that the suspect must be an immediate threat to the officer, which clearly does NOT apply here. A second factor is that he must be actively resisting or evading arrest, which, again, does NOT apply here. This guy definitely should sue… Here's a question for John, if you see it. Do police academies and departments actually train officers on the Graham vs. Connor (1989) Supreme Court case which established the Graham Factors? Or do you find in your work that they just don't give a shit?
