And to top off the last thing I said as long as they are on their property doesn't matter if it's a condo or an apartment building or anything like that. You as an officer cannot give somebody a DUI in their own driveway because you can't arrest someone on their own property without a warrant. So since you didn't have a warrant before you got there, you don't have any probable cause that they are actually committing a crime on public roads I can be as drunk as I want and drive around on my own property if I so choose main reason why I know that is cuz I worked at a campground during the Sturgis motorcycle rally. Every single person in the campground was drunk and also drove on property. Jo you sitting there saying that that parking lot is public. When it's not it is 100% private and you can't give anyone a ticket for anything on private property if you didn't turn your lights on before they pulled into the private property. Then your traffic stops illegal. Basically the same thing as if they would have gotten out of the car before you turned your lights on. You couldn't have done nothing. Let alone doing anything on private property but that aren't anyway
The only way that would be illegal to be in your car and not moving on your property even with the engine started. First of all, it's private property. You can't enforce law on private property that you do not own and since they are on their property as long as it's recreational in that state 100% legal and if it's cold outside and they have the car on so they can smoke 100% legal. It doesn't matter what you dumb cops say it matters. What the court says in the court definitely says you can't do nothing on private property that you don't own and that's owned by another
