There’s a dispute between a store and a customer. The store calls the police, reporting something that’s not a crime. The police show up to investigate the said non-crime. They demand ID. Now like many states, West Virginia does not have a “stop and ID” law. However, if they have reasonable suspicion a crime was committed, and that a particular individual committed that crime, they can perform an investigative detention which can involve forcibly obtaining an ID from a suspect. So what is the crime? Can the alleged crime of “trespassing” be used to detain and ID a shopper who has not been asked to leave the store, and who has not been given the opportunity, or even allowed, to leave the store by the responding police officer?

  2. Why is it tolerated when ignorant officer's dig deep and violate citizens rights and make unlawful arrest. What they've done is a crime and unlawful and they doit without hesitation or concerns in their behavior. This man needs to sue Wal-Mart the officer her department and the city. The officer should face prosecution for rights violations while acting under the color of law. The problem is clearly published when she said she didn't care and then the second officer should be fired and prosecuted as well. They can't stand the citizen knows the law more than they do and officer's will tell you ignorance of the law is no excuse. So why don't these officer's get prosecuted????

  3. So the cops should be arrested, handcuffed, fingerprinted for false arrest, kidnapping, slander, on top of that the PD and Walmart need to write a big fat check.

  6. The scary thing is the sad fact that most of these well-meaning cops believe the fact they "got a call," means they can legally demand ID without suspicion of a crime. Then the sergeant comes along and is dumb as his officer. Who is training these people?

  8. If a state requires the production of ID on request, then it seems to me that the state MUST provide IDs at no charge. Otherwise, residents might simply refuse to acquire an ID.
