I break it down, explain some of the relevant law, and show what happened. This couldn’t have gone much worse. Multiple Fourth Amendment violations….. and then there’s Walmart.
Reasonable suspicion is required to perform an investigative detention. Probable cause is required to perform a warrantless arrest. The “Graham Factors” are assessed to analyze the legality of the use of force which occurred. I’d guess the police here will fail miserably on all three.

I HOPE the victim's Response: Get all Names and Badge numbers; Walk away Get the name of the Walmart CSR ; walk away, Get child safely away by either calling someone or take the child home. Go to identify the Highest Rank supervisor/manager on the store and inform them the all of the the issue encompassing Store video from the time the issue case with the REAL Perpetrator to the point that I get in my car and drive out of this Walmart Lot is to now by Law be secure from any issue.i.e. erasure loss damage etc. My Attorney will be into collect the ELDENCE. Say Good Day and walk away. Also, inform them that this communication/interaction has been recorded. Then walk away .

John, threatening to call the sorry contractor Texas calls CPS was pretty low. Texas CPS primarily get's paid for initiating cases and by a formula of continuing activities performed; once CPS gets past your front door they tend to be "in your life " for a while, occasionally to the death.
I hope he sues for the child’s trauma as well.

Texas Penal Code, 3 802 one does not have to identify unless he has been lawfully arrested. These cars need to go to prison for kidnapping.
Wearing a face mask displaying the name of a suspected criminal may make one the focus of suspicion. Of course it proves him guilty of nothing.
