I'm going to take a wild guess and say it was probably the ex husband!
What was Ana really going to do in Spain, apart reconstructing a life for the reasons we understand? Who knew about it? Had she been involved in any type of activities before renting an apartment in Madrid? What were the her reasons for having business relations in Barcelona?
What would have been the advantage for David to construct such a complicated story? They had split, he had a new girlfriend! If it was really him to who drove to Madrid to harm her in some way, he obviously would have known that he would sooner or later land in prison. Or was Anna an important owner in their business – a rich person. A position which could have been an advantage for David’s new girlfriend in case of Anna’s disappearance? Check David’s cellphone to get evidence of everything, as mentioned in your documentary: I think David, if really involved, would have been clever enough to use another cellphone. Probably procured by the same person who googled the fake Spanish messages. That’s obviously the person of top interest! Must be one or several persons of non Spanish origin.

I can't speak to the Serbian side of this, but I am a foriegn national living in Spain (in the process of getting citizenship) and the red tape here is *crazy*. I have lived all over the world and Spanish red tape is by far the most drawn out. If there's a hold up anywhere, I would safely assume it's from the Spanish end.
