Sergeant H tries to be a nice guy and feels like he is a defender of the constitution. But even as a lieutenant now he is so brain washed following orders he can't see the forest through the trees. I ran into him some 3 years after this and he was shocked to learn that I was still fighting to get my property back. He was also shocked to learn that when I refused to agree to let them keep my drone I was sent to the county jail to sit and rot til my next court date and intentionally kept away from any phones. I had nobody to call anyway so the phone call didn't matter. Ricky Munday realized I was missing and Ida Foxy Queen made a video and people raised the bail and got me out some 5 days later. But while I sat there for 5 days, watching riot police beat prisoners and being herded like cattle with other prisoners, being shoved tightly into a room naked with hundreds of other men all standing around holding our balls in the freezing cold I learned a lot about our country. People were freely using drugs and I am not ever sure what kind. They were snorting something I think heroin. I watched grown men cry because they had jobs and business to go to and hadn't done anything wrong. There only crime was refusing to plead guilty. I think the worst part is these people had no idea how long they would be in there. And when you go back to court, what changes? You are still innocent so they send you back to the county jail. If you are innocent and you want out you have to plead guilty or they won't let you go. This was several years before any drone laws and I did nothing illegal. How Sergeang H can feel like he defends the constitution for following orders and arresting me, stealing my property and signing me up for a court without ever considering what they had planned for me is beyond me.
What did you think Sergeant H? You were going to use that mailing address on the ticket to send me phucking cookies and milk. They stole my property for over 3 years and sent me to county jail mfker. That is in addition to a dozen PC 148 cases I had going on at the time. I was innocent in every case and never convicted of any of that bullshit. You still defending the constitution asshole?

you are flying is a high security area , you can easily land on a cargo ship and take off while delivering or recieving contraband. its more of a threat to boarder security not the NAVY old war ship.
If and when anyone feels that their rights of citizenship in the U.S.A. any of the various states, counties, local cities or towns, have the right to go to court which will and would determine based on facts. The time to make your feelings of having your rights possibly compromised is not at the scene where it's being done.
Always comply, and take notes, then in a court, provide your case.
Military base is a restricted area.. you need permission from the military to fly in that area. Do your damn research!! People like y’all ruining everything for the law abiding drone flyers

State and local laws can regulate where you can launch or land your drone. They can also regulate how far away your active drone must be from people or particular structures. But can not make any rule in regards to airspace.

In the video you were recording a navy ship that was opened to the public for viewing. But was there any flight restriction? Is that an authorization zone to fly as in get automated approval by the FAA in AirMap or KittyHawk apps? What was the reason to justify seizure of your drone?
Usually it should only be a citation for a civil infraction. Also note, first responders has immunity to destroy your drone.
I commend you for fighting and standing up for what you believe. For me: Note I am only 3 weeks into drones, ever, at the date of this comment. Also from having background in law enfrocement and military education (not going to get into specifics), I would had handled the situation differently than you did. Not that what you did was wrong, it's not. Most any average individual would have had the same reaction you did. But here would be how I would had handled it: I would had politely apologize and inform the officers that I was unaware and will pack and leave the property of the shipyard immediately (be mindful that the officers alway wins at the scene even if they're right or wrong). I would also inform or make a remark "hey by the way gentlemen, I am sorry for misunderstanding the rules. But according to what I understood where it states (I would never ask them to show me where or what the rules are. I would have physical printouts of the rules from federal, state, local, and municipal in my drone's gear to show to them. Additionally aeronautical charts and/or FAA approval code to fly in that zone). Apologize, listen or try to understand their point of view, try to reach a mutual agreement, be polite, be professional, be respectful (not a smart a$$ or even hencing/implying that you are). Politely take the citation and fight it in court. The officers at the scene might be called/subpoena to a hearing infront of a judge. That day you can put on a sharp outfit, speak, and stand tall. Do your homework and build your case. On that day you will see who turns out to be the "real deal" and who would turn out to be a fool. None of that barking by the street "mucho" big man bullsh*t or some Joe with lots of "talk and no walk" whining. If you can comprehend what I am implying. If you want to make a change. Go to civil court and file a claim for an illegal seizure of your property (drone). Talk to a defense attorney and have them file for a hearing a date. That will raise the port police department's eyebrow and get their attention. Don't go begging for your drone like a sheep. You go about it using the law and if you are righteous, make them deliver it back to you. In addition to compensation for lost of time, duress, and depreciation of your property (battery unusable and such). If it was an illegal seizure, they must reimburse you if you can prove that your property is in a state less than what it was when they illegally confiscated it. But if you are wrong or violated something, then you have no say.
My last note in regards to drones in general. Fly with common sense people. As in don't hover over people or their backyards. Don't put your drone in a position within an airspace where there'd be a high risk of a mishap. Point your camera only to what's in plain view and where there is no expectation of privacy. Be discreet and constantly have situational awareness. Inform yourselves and be prepared for an encounter that will challenge the legal aspect of your activity. Check and recheck your equipment…Then you will not have a problem.
Well this video and you calling a drone that weighs more than 250g a toy is very questionable. Bet you know a lot about the constitution but nothing about FAA regulations…

Just curious if these guys were licensed and whether they checked for NOTAMs prior to flying over military event. Public or not. I can walk on the sidewalk in front of the whitehouse but in no way could I ever fly a drone there.

With that said, there is multiple sources you need to check before flying and temporary flight restrictions is one of them, also your not allowed to fly next to or over military installations. What were you cited for? why has the police department not released or even provided proof that they even still have the asset after 3 years?. Now I have heard stories about cops confiscating thousands of dollars from people driving to and from casino's – and they never even file charges. This seems to be a similar situation. The ass kicker here is that those people had to hire lawyers to get their money back – and that alone costs thousands.

If you hand them your drone they can take it. If they want it they need to seize it. Tough to get it back when you give it to them. I don't know exactly which port he was flying near but all I could see were legal places to fly a drone as long as you abide by the FAA rules which we all know

When people push the limits of law and regulations to the absolute maximum and instigate physical or oral engagements. The freedom we are dying for,long after returning from the battle field will be stripped away. I can’t believe how ignorant y’all are, you need to be more informed when you’re flying your drones around. The Navy prohibits drones from flying 3000 feet laterally, or 1000 feet above any navy vessel. You call it a toy, but to them it’s a surveillance craft to which the operator is no where in sight.

Lawyer here that actually specializes in aviation law… the US Navy was 100% CORRECT in asking you to leave. These UAVs are regulated by the FAA which SPECIFICALLY restricts fly zones for unapproved aircraft around US Navy Vessels. That drone weighs above 500 grams which means you must have registered it with the FAA (legally), and if you did then I trust you knew the law when you did it. This falls under Title 14 of the Code of Federal Regulations (14 CFR) § 99.7 – “Special Security Instructionsâ€, this specifically restricts drone use around military assets wherever they are regardless if photos are approved or not (drones can be restricted up to 2000 feet from a US Navy Vessel simply by the commander requesting it). Simply because the US Navy is allowing the public to board and photograph the ship in a controlled manner does not imply that the entirety of the ship is open to the public for study or photos in an uncontrolled manner. The US Navy has a vested interest in being able to control what and how the ship can be photographed and that's why they lead a guided tour (keyword being guided). These restrictions are detailed in Notice to Airmen (NOTAM), and outlines that the US Navy can ask anyone at any time to not operate a drone around a US Navy Vessel no matter where it is or whether it's open to the public. In fact if you actually took some drone classes with REAL people you'd know that flying around US vessels is a big deal.

The PIC was in the wrong. Airspace above Naval Ships is restricted per FAA Regulation.
