  1. field sobriety tests are not mandatory in California.
    Electing not to take them cannot be used against you. However, under implied consent laws in California, you must submit to at least one chemical test if you are lawfully arrested by an officer who believes you were driving under the influence.

  3. how are they going to find out if you been drinking if they don't do the test isn't there a saying buzz driving is drunk driving

  4. DUI checkpoints must post warnings so that drivers may legally take another route. You do not need to produce ID etc as there is no probable cause for the stop, it is a check point. This car is not in the check point. You do not have to roll window down or exit vehicle. All roadside tests are designed for you fail and are not required by law..
    This checkpoint and video is pathetic and worse.

  5. It would be SO refreshing to actually see a video of someone refusing ANY FST's or mobile breathalyzer tests!! WHEN will people learn that, as you said Katman and as I've said zillions of times, that a person is NOT required to submit to them?? It's so frustrating, it really is, because no good at all can come out of submitting to these. It can only benefit the cops.

  6. You CAN refuse DUI screening roadside tests, however, if arrested for DUI and the court finds that you refused the tests, your license is automatically suspended for a minimum of one year. There are repercussions for not consenting to the tests.
