26. Thanks Katman! I never get tired of stating the following: Field Sobriety Tests are VOLUNTARY. You can not be lawfully arrested for refusing these tests. Arrest for DUI requires probable cause. If arrested, take the blood test, breath tests are not reliable.

    What is stunning is the number of commenters who insist that these tests are mandatory, and invent all kinds of penalties for refusing tests.
