– I am unsure of the determination on this but suspect that once probable cause is determined the officer can collect the evidence needed to secure his case, but this is not a criminal case. So I don’t really know. Any attorneys please advise.

  1. There are a million "weird areas" of the law that are not clear by design, so the enforcers can selectively enforce the law on the ones that don't lick the officer's boots fast enough.

  2. You seem like a nice guy, but there are some "A Holes" out there that just want to give the cops a bad time because they are spoiled brats and were not raised by good parents. Truth be told, the cops could probably ask you to roll down the window because they had probable cause to believe that you were in violation of state code. In your case why would you not just comply and show them the exemption that you have. Then they will probably tell you to be on your way and have a nice day. You would not appreciate someone giving your wife or kids a hard time, so why are cops entitled to less respect ?

  3. Does it really matter what laws they create if they don't have evidence the law actually applies to you in the first place? Even if it's found you're in violation of the code, where's the evidence that PROVES the codes applies to you?

  4. Ok n California it's okay to have your test and side-rear windows tinted but your front door windows and windshield cannot be tinted over a certain percentage. If you are pulled over while your front door windows are rolled down, you're not required to assist the officer by rolling them up so he can check them. This is called self-incrimination which under the 5th Amendment you are protected. The officer must get a warrant for him to roll your windows up to be measured.

  5. TN Code 55-9-107. Motor vehicle windows with tinting, reflecting or sun screen material.

    (a)(6)(A) The restrictions of this subsection (a) do not apply to any of the following motor vehicles:
    (ii) Any motor vehicle bearing commercial license plates or government service license plates that are used for law enforcement purposes, for those windows rearward of the front doors;

    (b)(2)(d) It is a Class C misdemeanor for the operator of a motor vehicle to refuse to submit to the field comparison test when directed to do so by a full-time, salaried police officer, or for any person to otherwise violate any provisions of this section.

On my Corvette when I’m getting pulled over a roll them all the way down if they say my windows look dark I said that’s OK do you have evidence of that I’m not giving you any evidence because I don’t have to write the ticket I’ll go to court but I’m not giving you any window to examine I do not have to give you evidence against myself do you really need a lawyer to figure out the fifth amendment

  7. I was roll my windows all the way down and pulled over and if they ask me to roll them up to test them I said is it illegal for me to have my windows down because then I’m not gonna put them up

  8. I just throw big parties for local law enforcement with cake and ice cream and clowns and tell them they are wonderful fixtures in American society.
    Then they remember me as the cake clown guy who pats them on the ass and tells them they’re just great and get off without a ticket

  9. The fact that the lawyers you contacted are unsure because they want to measure it against prior court cases instead of the Supreme Law of the Land says the lawyers you contacted are just cogs in the statist machine.

  10. They can in the uk just the same as they can check to see if your tyers are still within the legal limits they can also ask you to turn your lights on to see if they work

    NO SEARCHING!! Not if there isn't an articulable suspicion… "do you suspect me of a felony or misdemenor?" Right?

  13. Interesting question. It COULD be like when the police suspect you of DUI, they are allowed to give you tests to determine your sobriety. Therefore, I would think they would be able to test your window tint from the OUTSIDE if possible but NOT from inside as that would violate 4th amendment protections.
