As part of California Vehicle Code Section 40804, any officer whose primary duty is maintaining traffic and enforcing the vehicle code must be in a marked car and in uniform. If the officer in charge of enforcing vehicle code is not in a marked car, their citation will not be valid and they may not be a witness in a trial for any citation they issue while in the unmarked car.

Section 40804 of California vehicle code is sometimes interpreted as meaning that no officers in unmarked cars can issue traffic citations, including speeding offenses. (ref4) This is not true, as officers in unmarked cars can perform this duty as long as their primary law enforcement duty is something other than enforcing the vehicle code.

  1. If it takes an unmarked police car to arrest drunk drivers there is nothing wrong with it job well done to the officers they may have saved someone's life!

  2. You can show they are in violation of 40804 if they go from traffic stop to traffic stop, and you showed this. Traffic stop and sifting between traffic stop.

  3. No front plate leads to " sifting "for felony guns or narcotics. Rookie cop stands in front of door then puts keys on hood not good.Driver may also elect a blood test.

  7. Depending where you live the definition of an unmarked police car can vary and the police certainly push the envelope. I've seen cars with ghost lettering (or none at all) and the lightbar inside of the vehicle. The police say this is marked. I would disagree but then I don't run the police department.

  9. I understand the purpose of these videos and I often agree with katmans viewpoints, but as a law abiding citizen I have no problem with the police doing what they have to do to keep the streets a little safer

  10. What a waste of time, effort and resources.
    In Australia, quite simple & fast , blow in analyzer if ok drive off ,unlucky if more than a minute, if bad you go to the police station or a booze bus next door for a more accurate analyzer. Handheld ones are not 100%, just an indication. If they're doing a mass check , they just block off a lane of traffic, not a whole direction.

  12. Personally I would never ever pull over for an unmarked car. In most states it is illegal for a unmarked or an officer not in uniform to do so. In this day and age of some impersonating an officer and some officers raping, robbing, killing. Yeah I would be in fear for my life and act accordingly with extreme prejudice.

  13. Michigan law states a vehicle must have markings on at least the passenger side to engage in primary traffic stops…Also, DUI checkpoints are prohibited by state constitution.

  14. I will admit that I don't really watch other peoples videos often so I might not be in a position to say for sure but my opinion is ONUS has the most informative and factually correct videos on the internet.

  15. Kat, our laws here in Mi. are similar. as strict as they are, and without even the best lawyer, the laws somehow lend credence to multiple dui offences. so, pretty much your f'd, but not enough to keep you from doing it again, and again,….cause somehow, your gonna keep finding that money.
