Albuquerque, NM – Prominent Albuquerque attorney David Serna was involved in a two vehicle crash on November 3rd 2019. When Officers arrived on scene they smelled alcohol on Mr. Sernas breath.

Mr Serna had just been arrested for DWI just a few months prior but that case was ultimately dismissed.

According to a criminal complaint filed in metro court, David Serna “appeared to be intoxicated” and was “having a lot of trouble standing, walking and balancing.” Serna, reportedly smelled of alcohol and was slurring some of his speech. Mr Serna told officers that he’d had a beer about half an hour before the crash. A breath test later showed his blood-alcohol level was at least twice the legal limit scoring .16 on both samples provided, police lapel video showed.

So, an attorney is arrested for Aggravated DUI (after a previous arrest for DUI shortly before this one),and he receives preferential treatment by having an officer taking his belongings to his home? And because he’s an attorney, his charge will be dropped to “just” DUI (the “aggravated” enhancement waa for his BAC being twice the legal limit), or it may be dismissed completely just as his previous arrest “just because”?? That’s fair.

  10. so i looked the guy up and apparently he had a half dozen arrests for dui, but this was his first conviction
    go off on the others through technicalities
    and on this, despite it ending in an accident, he got a simple slap on the wrist
    man is a dangerous alcohlic
    he is going to kill someone

  11. Not the best camera work on this one. The acting wasn't exactly award-winning either especially when gramps finally "admitted" he had "one beer".
