Riverside, California — On Tuesday, January 26, 2021, officers assigned to the Riverside Police Department’s METRO Team conducted surveillance in the 4600 block of Tomlinson Avenue for a wanted parolee at large. The suspect, identified as 29-year-old Xavier Daniel Lopez, had recently led officers in pursuit on Tuesday, January 19th, but was able to evade the pursuing officer along Adams Street and the 91 Freeway. Officers were able to determine his identity and learned he was on parole for assault with a firearm and wanted on an outstanding parole violation warrant.
Due to the Lopez’s history of violence and use of weapons, the METRO Team began looking into his whereabouts. At approximately 4:10 p.m. and after about 40 minutes of surveillance, METRO Officers observed Lopez and attempted to take him into custody when an officer involved shooting occurred. Paramedics with the Riverside Fire Department responded and treated Lopez, then transported him to a local hospital, where he recuperated for two weeks before being booked into the Robert Presley Jail in Riverside. A firearm was found in the Lopez’s possession at the time of his arrest.
Following a preliminary hearing at the Riverside Hall of Justice, Riverside County Superior Court Judge Randall Stamen found there was sufficient evidence to warrant a trial on an evading count, as well as resisting arrest, being a felon in possession of a firearm and brandishing a handgun at a peace officer. Lopez pleaded not guilty to the charges and is scheduled to face a jury trial on May 20. He remained jailed in lieu of $1 million bail.

Everyone is saying this officer is trigger happy, but a lot of people also don’t understand how the brain processes what the eyes see in a high stress, adrenaline pumping situation like this. Was it tragic? Yes absolutely., but this goes back to, if you want to keep your life and freedoms don’t be on parole and carrying a firearm. He did reach for it initially.

Lots of things wrong with this one unfortunately… This cop was way to eager to get into the conflict and put himself and the suspect/victim in unnecessary danger.

He was convicted for assault with a firearm before.
When the officer arrives you can see he attempts to pull out the gun in his inner left jacket pocket.
After he notices the officer already had his gun on him he pulls his hand out.
The amount of time he had his hands up was 1 second before the cop shot.
However his hands were still right next to where the gun was but just facing the other way and could've pulled the gun out any second.
Overall this was justified honestly.
Yep can't defend the officer on this one. The man had his hands up. Although I do wonder why this shooting isn't in the news? Ma’Khia Bryant was shot on the 20th of April and this video was uploaded a day before her shooting. Seems a little weird that the media gets to pick and choose the story that fits whatever they want the public to know.

This one is odd because although the man is clearly shot whilst both hands are visibly up, the second the cop exits his patrol vehicle you can see the man reaching for something. I’d honestly call this one unjustified in my opinion.

Sorry Mr. Stamen had his hands up within clear view of all to see. The shot was delayed. I believe the officer spotted the firearm within Mr. Stamens blazer and focused on that, then pulled the trigger out of reaction rather than noticing that his hands were empty at very moment.
