A man being trespassed from a local business refuses to provide his name and date of birth, leading to charges for concealing his identity. But that’s nothing too unusual. After all, people conceal their identity all the time.

What is unusual is that this gentleman doesn’t speak English.

Because someone is inevitably going to ask, the New Mexico statute making it a petty misdemeanor to conceal one’s identity can be found at NMSA 1978 § 30-22-3:

“Concealing identity consists of concealing one’s true name or identity, or disguising oneself with intent to intimidate, hinder or interrupt any public officer or any other person in a legal performance of his or her duty or the exercise of his or her rights under the laws of the United States or of this state.”

  6. Truth of the matter is that you do not have to give your name and birthday or even provide an identification to be trespassed. I know it sounds stupid that you don't have to give your have because common sense says you would need a babe l name to trespass for the future but the law actually doesn't say you have to provide it. They can actually similar take a picture and then trespass him and identify him in the future using the photo without a name. And to be trespassed you have to be asked to leave first, and if you do not leave your request to do so THEN they can give you a trespass warning. And you have to leave but still didn't require to have to ID yourself. And the officer saying "you can be arrested for failing to identify is actually not true. Failure to identify cannot be the primary charge. There has to have been a crime committed first and a charge has to be made in order to them use failure to ID as a secondary offense. If the guy isn't being charged with a crime, he doesn't have to legally identify himself which means failure to ID doesn't stick and it's a false arrest. And he hasn't been given the opportunity to leave the premises yet because he is detained on the property. So these cops are totally out of their legal right to demand ID. I mean they can ask, but if he refused they can't do anything to him for refusing. And he isn't even being allowed to leave you request so the trespass isn't even warranted. He didn't say he want going to leave. He asked to leave but he was told he isn't free to leave. Although I usually might agree with dumb people saying don't things to cold to give them a hard time, in this specific case he's actually well within his right to not ID himself. He can literally leave the property in request which he's willing to do so why complicate things by forcing to stay and do trespass documents? None of this is necessary. SMH

  9. He can’t sign his ABD’s very well. He apologized for something than decided to sign the alphabet. I have very very very limited ability to communicate with the deaf. I’m only at 3.5 minutes. This guy is under my skin. He is sitting crossed leg and taping his foot. I doubt he is confined to this chair and I suspect he might be off his meds.

    I honestly thought he was opening a mail order pizza. Moving on.

  10. He doesn't need jail. He needs a mental hospital. The police also need training on dealing with the mentally ill. It's obvious the wheel is turning but the hamster isn't home.

  11. He is Deaf or Hard of Hearing Person.. (ADA Law): Police cant shout at them at all. Must Writing notes to each other.
    So, ADA Law is must have Sign Language/Oral Interpreter provided under the Americans with Disabilities Act, the Rehabilitation Act of 1973 (Section 504) and PA 204 of 1982. {Arrange for a Nationally Certified or a State Qualified Interpreter to Facilitate our effective communication}
