Actually they can for most misdameanors with approval of the shift supervisor or seargent they can write a misdameanor citation and/or take you to jail in that respect they have a lot of discretion. Your cool their cool you might get off with a citation to show up to court, unless your a punk then they might put you in the jail till your court appearence. That's why…for the most part(small stuff) it's better to just not argue, "yes sir, no sir" be cool and you'll(for the most part) be ok

  2. And that's PRECISELY how that ought to work. I don't care if he hit you before, revenge isn't legal and it shouldn't be. You could've just had him charged and that's that, but no, now YOU'RE dumb ass is getting charged with battery.
