Picking up where we left off in Part II…

(Tempe, Arizona) On October 26, 2018 at approximately 8:40am, self-described Navajo Indian Shelton Christopher Begay was riding a Bird electric scooter in the number three lane of southbound Rural Road approaching Broadway Road in Tempe, Arizona, when he swerved and collided with a vehicle driven by G.S., who was driving a Dodge Dart in the number two lane of southbound Rural.

Begay fled the scene but was quickly located at 1105 East Broadway Road when a passerby saw him laying on the median, “holding his scooter and his head.” Responding officers noted that Begay appeared intoxicated, and a subsequent blood test would reveal that he sure was — lab tests returning a remarkably high .285% BAC.

This video covers the second half of the police and fire department encounter with Shelton Begay, as they further evaluate his story and injuries, and G.S. makes another appearance, this time to positively identify Begay in person.

Begay was transported to Tempe Saint Luke’s Hospital for treatment of his injuries. A slew of charges were recommended by police, and the prosecutor ultimately charged the scooterist with super extreme DUI (.2% BAC and over), endangerment, reckless driving, and criminal damage.

Of note, Begay has the unenviable honor of being the first electric scooter rider to ever be charged with DUI in Tempe. Self-congratulation aside, where are things with this case now? Different from yesterday, if you read the description two days in a row? [Answer: Not really.]

On January 18, 2019 Shelton Begay failed to appear for his arraignment and a warrant was issued for his arrest. Apparently not thrilled with Begay’s failure to appear, new charges were filed alongside the FTA warrant. The new additions: failure to remain at the scene of an accident and failure to exchange information at the scene of an accident.

If convicted of only the DUI charge, Begay faces a mandatory minimum of 45 days and a maximum of six months in county jail as well as over $3,000 in fines and fees. Arizona does not mess around with people who drive while intoxicated.

Speaking of Arizona law, some people apparently assumed that “super extreme” in the video title was an attempt at getting clicks. I’m going to point my finger at the Arizona legislature, though, because they invented the admittedly-title-friendly naming convention. See ARS 28-1382. “Driving or actual physical control while under the extreme influence of intoxicating liquor; trial by jury; sentencing; classification.”

  1. On an Army post you’re DUI if driving anything consisting of 2 or more wheels/tires while intoxicated. So technically you can’t ride a bike or scooter but you can legally ride a unicycle while drunk. I never saw anyone try, but it would be funny to watch.

  2. They didn't test the young cute chick…. Amazing how the justice system works. The second lesson here is don't get into a accident with a cure girl when their is a horny cop around. I wonder if she's one of the gas station girls cops love to hang out at and flirt with. We all know they do that and if you don't your ignorant to the obvious. The girls at my local gas station laugh about them when they leave 😂.

  4. He's injured, so why are you running him through sobriety tests? This arrest is definitely a social commentary! A seemingly innocent white girl vs. Navajo Native Tribe member (still in his ancestoral home)…and the winner is…Dee White Man😖🥴😵

  7. 15:20 The cop shuts his body cam down for 10 minutes (peep the time code). I understand the officer was frustrated but I do not think it's appropriate for officers to decide what is recorded and what isn't. This is 2021; digital data storage is cheap and plentiful. These body cams should be turned on as soon as they clock in and then only turned off when they're shift is over. These officers playing Christopher Nolan & amateur film editors is some bullshit.

  8. Clearly guilty but the fact the EMTs are acting like they’re concerned for him at the end just so they could get him strapped in and a needle in the arm is alarming. Clearly this is how they were able to get his BAC.

  9. Dude a scooter!!! These officers should be fired for lying and filling a false report. How dumb can he be saying a scooter and a bike are the same thing as a motor vehicle. This is insane what has law enforcement come too. Police shouldn’t even exist anymore, there thought process in mind blowing.
