If some of the comments I have seen here are any indication, there are a sizable number of people who mistakenly believe that field sobriety test results are necessary for a drunk driving arrest. Those elite few believe that they have the system figured out. According to them, without the results of some sort of field test (either PBT or SFST), even the most sloshed of drivers gets sent on their way.

Well, that’s not how it works.

  1. I got stopped once for DUII. I was the designated driver and the officer asked for SFST. I agreed and got sent on my way because I didn’t have anything to drink. She thanked me for my patience, and then I got stopped three blocks away 😂. The first officer drove by and just shouted “he’s good”

  2. Although I don’t condone drinking and driving. Never admit to drinking and just tell the officer you refuse to do the field sobriety test or the mobile breath test. Do not answer questions as the officer is just getting information to show to the court and is testing you to see if you have lied and were aware of what happened.

    If you have drank and may be tethering on a .08. It may be better (depending on the state) to refuse.

  3. Anything you say will be used against you, never for you. She was half way home, refused the test-awesome job. Then…"I had two wines", should have just said "I don't answer questions". God so close!

  4. The refusing to do a field sobriety test is just being smart. Everyone should refuse to do them because they are stupid and unreliable.

  5. Field sobriety is optional, an officer needs probable cause to arrest someone for being drunk. Field test is designed to make an arrest easier to sustain in court.

I don’t condone drinking and driving but obviously if you know that you’re in trouble keep your mouth shut politely say I’d like to speak to an attorney and not answer any questions and do not under any circumstances perform a field sobriety test… And believe me If he thinks you’ve been drinking you’re already going to jail watch after he knows you’re not taking field sobriety test he makes a point to ask you again have you been drinking and how much have you had to drink…

  9. You never EVERRR take field sobriety test!! Come on people… all it does is build a case against you and helps the officer justify arresting you from driving while impaired.. Even if you aren't drunk or drinking. Odds are, if the officer is asking you to take the sobriety tests. Hes already determined your drunk…

  13. The police will not tell you this but it is not mandatory to take a field sobriente test or a Breathalyzer test. It should be called field sobriety exercise because to call them a test is ridiculous. Just stay quiet and be respectful and deny everything but most importantly don't drink and drive

  14. CAPS FOR A REASON: SOME PEOPLE SAY THAT IF YOU REFUSE A FIELD TEST, IT'S NOT PROBABLE CAUSE FOR AN ARREST. I'VE SEEN VIDEOS WHERE REFUSAL IS AN AUTOMATIC ARREST. REFUSE BREATH TEST AND/OR "HOLD YOUR HAND TO YOUR NOSE" TESTS, YOU'RE GOING TO JAIL. DON'T DRINK AND DRIVE. IT'S NOT WORTH IT. I HAVE FAMILY MEMBERS WITH 3 DUIs. THEY'VE LOSE THEIR LICENCE AND JOB. LET ALONE THE EMBARRASSMENT OF GOING TO JAIL. I COULDN'T OPERATE WITHOUT A DRIVERS LICENSE, SO I CAN'T IMAGINE GOING FOR 90 DAYS OR A YEAR MUST BE LIKE.

  15. Best thing to do is refuse a field sobriety test, and don't answer any questions. A good lawyer will usually destroy these cases.

  16. She’s smart. The officers ‘observations’ are enough to suspect dui. The field sobriety test and the pbt are used to give the officer probable cause. Refusing them is completely legal and there is no punishment for refusing. Suspecting dui is not enough to form probable cause, and if he gets a warrant for blood, the whole case can be dismissed based on lack of probable cause. She should have not talked, however. At all. Said nothing. Stand mute.

  17. Can someone tell me the point of a sobriety test? It seems that even if someone passes it, the police still breathalize you anyway. I don't understand why they waste time doing those tests and don't just cut to the chase and test them with breathalizer? Must be a reason for it though…?

  20. A little slow to respond? Well she was just in a accident. It seems that if you have the “odor” of alcohol, you’re automatically “too drunk to drive”

  21. It's not official until she blows over the limit or fails a blood draw. Cops love you to implicate yourself.

  22. Pig bois can arrest you with no evidence whatsoever.. Refusal of FST"S means you will not have the results to use against me(evidence).. I would also advise to never, ever talk to pigs, just have your window down an inch, and always remain silent..Ask for your lawyer to be present during any,and all questioning and that will shut their slopholes up..
