It was a strange night shift for Officer Larry Miles of the Boise Police Department when he encountered a man snooping into a shop’s window. The suspect attempted to give a false name but was unable to spell it correctly when asked to do so.

If you get a good lawyer, they can argue that as the cop was looking for weapons, he had no legal reason to remove a baggie as it does not resemble a weapon.
Note that this defense only works if you're rich and/or famous. If you're an average person they'll laugh it off and convict you anyway.
