Carson, California — On August 7, 2023, at 1:53 a.m., Carson Sheriff Station received a 911 call from a store clerk reporting a man causing a disturbance at a gas station. The caller said the man, later identified as 34-year-old Arturo Cernas of Los Angeles, was screaming at the gas pumps and would not leave. Carson Station deputies were dispatched to the call. Cernas eventually complied and got on his knees. Deputies repeatedly told him not to reach for anything. For approximately a minute and a half, Cernas remained on his knees with his hands on his head.
He suddenly reached into his right pocket for a cell phone and reached into his backpack. During this time, deputies gave repeated commands for Cernas to stop moving. Cernas then grabbed the pistol from his left pant pocket. When Cernas reached into his pocket and grabbed the pistol, one deputy fired a less lethal 40mm foam projectile. Cernas continued drawing the pistol and, almost simultaneously, a deputy discharged his service weapon. Deputies rendered medical aid until the arrival of Los Angeles County Fire Department Paramedics. Paramedics pronounced Cernas deceased at the scene. After the incident, it was determined to be a CO2 BB pistol which resembled a firearm.

I wasn't there and it's not my life at risk so in truth my opinion doesn't mean anything. I do however having fairly good feeling for body language and I really don't think this guy was trying to shoot them. When he first put his hands on his head he kept holding up his left hip to them, basically saying just take the gun I'm not going to shoot you. They backed away to their vehicle which I'm sure is policy. The other justification for the shooting is that there were other people around so even if he wasn't going to shoot it them he could have shot at an innocent civilian. I just think I might have given him an extra second to see if he was throwing the gun. I don't know for sure that I would have but that was my first instinct watching this. Again I'm not there, my life's not in danger so maybe my instinct is wrong.
They were close enough to taser him but chose to retreat.

Guy was throwing it. I know once the video from the store was watched, the officers realized what they did. But Jesus. This guy was, in my opinion, looking for his hair tie, moved his backpack after a quick look, then threw what he knew looked like a real weapon, but the fact he went for the left pocket meant Danger to the officers. This guy was on something. He was seemingly goofy and just nonchalant. I can't fault the officers in fear, but I can also say, yeah, he was being a butthead to patrons, but thought he was complying. Nobody wins here.

Listen. Yes, it’s obvious that he was trying to throw the gun. However, the officers don’t have the same view as we did, and they didn’t know it was a BB gun either. When your life is at danger, you have to assume the worst and be prepared for it.
