On December 20, 2011 Antoine Lee Bynum killed his longtime girlfriend, Remmi Goyens. He claimed that his girlfriend had “put a voodoo trick” on him, and that the trick had resulted in voices in his head telling him that he could have been an NBA star or an NFL player.

In August 2016 after multiple incompetency determinations Bynum was declared competent and his case finally went to trial. A jury found Bynum guilty of second-degree murder and Bynum was sentenced to life in prison.

Interestingly, Bynum’s judgment and sentence were appealed, and on May 11, 2018 the Fifth District Court of Appeals remanded his case for further proceedings.

The defense had argued that the trial court committed fundamental error when it failed to “make an independent determination of [Bynum’s] competency.” The court of appeals agreed and reversed – but only for a retroactive competency hearing. (On all other matters the court of appeals affirmed.)

That competency hearing was held in Florida on August 3, 2018. The court retroactively found that Bynum was competent to proceed and issued an order to that effect, thus rectifying its previous error. Bynum is serving a life sentence.

For those interested, the details on appeal:

On April 26, 2015, the day before trial was initially scheduled, Bynum’s counsel filed a notice of incompetency. As a result, the trial court held a competency hearing, and after considering the reports of two court-appointed experts, found Bynum incompetent to proceed and committed him to the Department of Children and Families (DCF) for treatment at a state hospital in accordance with Florida criminal law.

On August 31, 2015, mental health professionals at the North Florida Evaluation and Treatment Center filed a report representing that Bynum’s competency had been restored, and at the request of Bynum’s attorney the trial court once again appointed an expert to evaluate Bynum.

The trial court then held a competency hearing on October 22, 2015. However, no evidence was received at the hearing. Rather, Bynum’s attorney conveyed to both the State and the trial court that the expert had found Appellant competent to proceed. Even though it had not yet reviewed the expert’s report, the court found Bynum competent to proceed “based on the accord of [the expert], and based on the stipulations of the State and Defense.”

The case then proceeded to trial on August 8, 2016, where Bynum admitted that he killed Goyens but raised an insanity defense. The jury convicted Appellant of the lesser-included offense of second-degree murder.

The court of appeals held that the trial court had committed fundamental error when it found Bynum competent to proceed based upon stipulation of parties and expert’s report which court had not reviewed, rather than making its own independent determination regarding Bynum’s competency. Essentially, the court must always make an independent determination as to a defendant’s competency to proceed; accepting a stipulation of the parties as to competency is not permitted.

  1. It's absolutely pathetic that the court system went through all of that (explained in description) as if there was ANY doubt that he's faking it the whole time. From the surveillance video to interrogation. FFS…

  2. "On April 26, 2015, the day before trial was initially scheduled, Bynum's counsel filed a notice of incompetency."
    – He was acting like this right from the start, and his lawyer didn't catch on until the day before the trial… sounds more like a case of incompetent defense.

  3. This guy is faking. How do you go from being schizophrenic back to normal and remembering every single detail. Schizophrenic people are out of their heads.

  4. "I was just goin' nuts" , if one is nuts or going nuts as he says….there's a slight chance that the NUT will not confess it. Most of the time certain psychological ailments causes one to lose touch with reality and to them what they're living IS reality. And sometimes, recall isn't doable, especially total, complete recall. Nope, not buying the insanity defense.

  5. Yessssss ~ 🐍🐍🐍 crooked alligator, holding that "S" a loooooong time.

  6. 1:07:33 Why the heck was that black female cashier trying to confront and handle this man. Did she not realize or understand the danger or who or what she was up against, even if she wasn’t aware of what he just did? That guy is over 6 feet tall. He walked into the store with a bloody shirt on, talking insane and she wanted him to come out. NO, let him stay in there and you GET OUT of the damn store. Then she had the nerve to ask the other woman, “You gonna just stand over there and not help me get in the door?” Uhh YES! She has sense enough to not run up on danger and to exit the store instead. Black women have to stop trying to heroes. And why did the police not instruct her to take her ass outside?

  7. Sorry but I don’t see it being mental illness . He knew what he was doing and he knew enough to say if his daughter was there he wouldn’t have done that. Sooo yeah I’m not buying it sorry. To many 🚩!

  8. Could you imagine how scared his gf must have been? Her bf is blaming the voices in the head on her while he's angry. I can't imagine the fear she felt.

  9. I believe em! I don’t think he was faking that shit at the store! I been fucked up an confused a thousand times!! Haha an that is what it looks like!he ain’t playing

  10. Yeah ,I'm annoyed with her rubbing her face, sniffling, nose digs, get a box of Kleenex and a shot of Robitussin, Sudefed, something , and hand sanitizer!!!

  11. Yall railroaded this man…you can clearly hear he is not competent but bc hes black he's guilty. Fuck yall P.O.S he loved her and if he wouldnt have been beat in prison and put on meds he wouldnt have never harmed her. Bet if he was white he woulda been found incompetent

  12. Crazy thing is….. he telling the truth… y’all will look at the man as a joke.. forget the voodoo trick.. he don’t know what’s going on so he’s calling it that… y’all think all the ppl in world that has this kinda story “voices in head” is a coincidence??? Think logically. Research “MK-ULTRA OR V2K” my condolences to the family..
