Police Investigate Incident at Albuquerque Gas Station, Part I (The Complaint) – Everything Law and Order Blog

The complainant was getting a couple of fountain drinks at an Albuquerque Shell gas station when an exchange took place between her and an employee who was stocking shelves.

Neither of the two seem to have been thrilled with the other’s reaction and things escalated. The woman may have been told to leave the store, but detail about that is [predictably] fuzzy in her story. What is clear, however, is that at some point a security guard showed up and forcibly helped her out of the store. The woman was not happy – because she is “not homeless” (not quite sure how that fits in her story, but it does) – so she called the cops to report what had happened.

This individual came into the store and once she decided that the clerk was in the wrong started yelling and throwing things, so I asked her to leave because it was, in fact, on private property. We have the right to refuse service to anyone, for any reason. I tried to get her to leave peacefully but she just wasn't having it. I was responsible for the safety of everyone on that property. Not just her. When people start making issues like this on my properties the choice is either to detain her, or make her leave. I wasn't about to detain her because the cops never show up on time to get them charged anyway. So I just made her leave. She assaulted that Clerk and myself. Then her brother or husband, whoever that other guy was, decided that he was going to try to hit me with his Cane. I was only there to keep the clients and customers safe. I reacted in a way that I was trained. Why do you think they dropped the lawsuit against me. They watched the in-store video and determined that she was lying. I get stuff like this all the time. Every time you offend someone they want to sue you.

  10. Also, I know of that gas station attendant she's speaking of, He's been at that particular gas station for a least a few years, I HIGHLY doubt Everett would do something like that.
