San Pablo, California — On Wednesday December 15, 2021, San Pablo Police received a 9-1-1 call from a store clerk in the 1300 block of Market Avenue reporting a man in the parking lot carrying what appeared to be a firearm. At one point the clerk described the man taking the magazine out from the gun and putting it back in. The clerk expressed fear the man was going to enter the business. The clerk advised the man left in his vehicle recklessly from the parking lot.

Multiple San Pablo Police officers responded to the scene and located the man’s vehicle traveling west-bound on Market Avenue outside the city limits of San Pablo and initiated a high-risk traffic stop. The man pulled over to the side of the road and officers attempted to communicate with him. During this exchange, officers noticed the man had blood on his hands. They gave him instructions to exit his vehicle and put his hands up.

After a brief exchange of words, the man exited his car while holding a firearm in his right hand and faced the officers. It was later learned that the man was in possession of a BB pellet gun that closely resembled the appearance of a real gun. Officers repeated orders to the man to raise his hands while he mimicked the motion of racking the slide of a firearm as if making it ready to shoot. The man then pulled the gun to his chest, and turned towards officers. Four San Pablo police officers discharged their service weapons striking the man. Officers immediately began providing medical aid until the arrival of paramedics. Unfortunately, he was pronounced deceased while on the way to the hospital.

It remains unclear why the man was in the store parking lot brandishing the pellet gun or why he exited his vehicle holding the weapon and mimicking the actions of a real firearm in the presence of officers. During the course of the investigation, Detectives learned the man made statements to a witness of his intention to force officers to kill him. It was also learned the man made statements of “goodbye” to family members earlier in the day.

While at the scene at the onset of the incident, investigators believed the gun to be an airsoft gun which generally discharges plastic projectiles. In accordance with Assembly Bill 1506, the California Department of Justice was called to the scene to assume the investigation. After all evidence was collected and further analyzed by the Contra Costa County Crime Lab, it was determined the gun was in fact a BB pellet gun capable of discharging metal or lead BB’s. California DOJ identifies a BB pellet gun, even if unloaded or inoperable, as a deadly weapon.

  1. How fed up your life do these people have to be to get to this point. So very sad. The suicide rate has been skyrocketing in our country since last year. Please check on your family members .

  2. California is weird. Of course dumb gun laws (which my state is just as bad or potentially worse). Then they get a call of one guy with a handgun and send 6 cops with at least 2 having AR-15s. California just has some of the best bodycam videos, especially for S.W.A.T. but most is like 1 person with a semi-automatic gun by themselves (no hostages/victims) and they always bring half of the police force to deal with it. If only more police forces had the funding/people to deal with worse situations.

  6. Pretty switched on department. Always good to see cops respond to armed suspects with a patrol carbines rather than their sidearms, and that was some controlled fire and a well-managed approach.

  7. BBs are metal, pellets are lead. "BB pellet gun" is a term I've never seen before. I've seen BB guns and pellet guns but never a BB pellet gun. Some are capable of firing either, but they usually aren't called "BB pellet gun". I think the California DOJ calling a "BB pellet gun" a deadly weapon is kinda silly. They should at least have a caliber or energy cutoff, because while you could shoot your eye out with a Red Ryder BB gun, it's only a deadly weapon to mice and birds.

  9. If a friend or family member tells me “goodbye”, I’m not just going to tell them ok, goodbye! I’m going to ask questions and dig further. Maybe if they had done so, since it was done earlier that day, it could have prevented all of this. Now their loved one is dead and those officers have to live with this for the rest of their lives.

  10. I feel really sorry for those so desperate they’re willing to end their life. But if you’re determined to do that don’t involve others, including Police in your in your plan. The damage to Police officers who have to kill a person is severe.

  12. The amount of times we've seen these badge cam videos where an officer uses a patrol rifle and the suspect survives are very few. Pistol survivability even with the +P LE rounds seems at least a decent possibility unless head shot or center/high chest…rifle, not so much.

  13. Holy fuck.. Rush hour in the line of fire.. why didn't they get someone to stop traffic before shooting with high powered rifles and handguns.
