A quick way to spot justifications for wrongful action by actors is to catch them in the act and record every detail of the conduct, a clear display of fact and not “appearance” alone.

It appeared to evaporate from a creditable line for an “affirmative defense” when the standard of care is not heard in the argument… Honestly, they had you by prior judicial decision, subject no waiver. Why do they take this extra step? The U.S. Constitution prohibits government denial of “equal protection” of the laws; state and federal statutes guard against discrimination on the basis of individual characteristics (e.g., race, gender, disability, age, sexual orientation or identity). The relevant state or federal authority does not use the term “equity.”
