  3. OMG! People sue over anything these, this argument over the use of the car is not logical, and is total nonsense! Reminds of that guy who sued McDonald's because he got burned by the hot coffee! The sad thing is he actually won that lawsuit. Coffee is hot!…that's common sense!

  4. Like saying spoons are for eating but we can use them for that heron, cars are for driving not for sex, but if you decide to have sex in a car now that's way too personal of a choice. This privilege shet is going too far

  5. Under the lighter situation there are warnings that are in the users manual for the use of the car. For decades people have used cars to make out. There are certain German cars which the front seats are able to lay flat so it is easier to say get comfortable 😎👍.
    So the defense of using the car out of the "scope of practice" and/or use is kicked out the window. For it is reasonable that just like using the car to transport people, food, materials and furniture, it is use to sleep as well. And where people sleep they are most likely to use that area to have sex.
    Now, even though the words "use of the car" is an open to full use in anyway. There is a way Geico has a leg to stand on.
    1) If the car manual for that particular car has a warning against having sex in the car.
    2) If the lawyer flips it in the way that shows that the victim caused or was partially to blame for the injury/damage to themselves.
    Example: if I am the passenger in a vehicle and I decided to bang my head on the window can I sue to insurance company for my injuries? Or say the car is traveling at 20 miles per hour and I decide to jump out the car, is the insurance company liable for my decisions? The answer is NO!!!
    It is well known that STDs are out there and if you are having unprotected sex then you are the cause/partially cause of your injury/damage to oneself. I think it's a nice try with the loophole but in the end, the Case will be dismissed.

  6. my heart goes out to the attorney who had to take the time out of their day to listen to her story, write up a brief, have a clerk deliver and file said brief at the court house, and then stand in front of a judge and explain this crap.
    this is stupidity in the worst way

  7. FYI…You can be infected with HPV without being sexually active – as HPV spreads easily through skin-to-skin contact, it is possible to be infected with HPV without having sex. Prolonged contact with infected skin, such as holding hands, may cause transmission of the virus.

  8. The last time a woman came up with a big insurance scheme… she cut her hand off, lost her bf, received no cash and went to jail. So you gave buddy some top… he busted in your mouth… and you figured "how can I turn this into a mil-ticket??" Here's an idea for ya!! Claim your bed as a business expense since you're always lying on your back… it's work related, RIGHT??

  9. That's not gonna fly any more than someone spilling hot coffee on your leg in their auto insured car. Geico is for driving that car, you get into a road accident, or somebody hits you. Or maybe steals your car and goes joy riding. All the crazy chick can do is sue the bum who gave her the disease. The disease did not come out of the car's air vents. 🙄

  11. They should have called Farmers Insurance; I’m pretty sure they have a statue of this incident from a Caprice Classic in the 80s. I don’t see how they have a case If they weren’t driving while having sex in the car. As far as I know; HPV did not come standard in any make or model of the Hyundai Genesis. 😌

  12. This female ain't getting a dime. The insurance covers "injury" to the insured. By definition, a disease is not an injury. Law firms and competent attorneys are aware of existing case law that established that difference in past court cases that involved employees suing for workers compensation money

  13. Shouldn't she have to prove she caught the STD in the car. She may have caught it somewhere else. I think she shouldn't be allowed to sue, she chose to have unprotected sex. You wear a seat belt when you get in a car she should have worn a condom. It's a BS case.
