You've probably seen the "arrest for laughing" case that has gone repeatedly viral over the past few years. I'm actually the attorney on that case. Just yesterday the Court ruled on the officer's motion to dismiss and request for qualified immunity. The officer claimed that flashing headlights to warn oncoming motorists was not protected free speech, and that he was justified in handcuffing, frisking and detaining the driver after he laughed at him. What did the Court rule?

  2. To be fair, I have property in Nicholas County, and drive through Summersville all the time, and I see people speeding all the time. But flashing your lights to warn other drivers? That's absolutely legal. People do it all the time to warn people of downed trees, deer, or other dangers ahead. We as taxpayers should not have to pay for this. It should come out of the pockets of the Sheriff and the officer.

  3. He was laughing at the absurdity of the situation, were the cop from the first instance was demeaning the driver by calling him stupid and further on threatening with arrest for the unsigned document. An absolutely absurd situation in which I would also be laughing..
What a little man that cop is!

  4. The police captain on his PSA – Does all he can do as to a Kamala Harris word salad copsplaining . He is so full of himself that we can see and smell his cesspool oozing out of every human pore from his demented mind. This PSA was brought to you by scratch and sniff the poo poo he has to clean up from his thug boot licking bottom he stepped into.

  5. The law quoted by the officer regarding flashing lights is real and has a reason that is valid.
However it applies to the impersonation of emergency vehicles and is worded as to make such a distinction obvious as not to apply to the flashing of high beams to warn other drivers of a hazard.

  6. Progress. Thanks TCRL for fighting the good fight. Watching the video of this interaction, it's hard not to think that this deputy is just an ordinary deputy, no different than any of his peers, who sees it as routine and proper to punish law abiding citizens who don't show sufficient deference to these badged goons. It's totally insane and must be fixed.

  7. WHAT IS BS…even when they lose qualified immunity, the city still comes in and pays for them so they really DGAF and act accordingly….🤔UNTIL THE VERY SECOND their personal $ is at risk, they will continue to NGAF about violating our rights🤔 Not sure of ANY officer that has had to actually pay for their BS…..

  8. This guy only laughed and this pig got butt hurt I wonder what he would do if u didn’t answer him or gave him the finger you know he would do a lot more… now he trying to get qualified immunity and didn’t get it now we all laughing at you dummy!!
