ATF Agents Show Up at the Door to Check Firearms Purchases – Everything Law and Order Blog

Video footage was released from a Delaware man’s Ring Doorbell showing two ATF agents and one Delaware State Police trooper questioning a homeowner about recent firearms purchases. Do they need reasonable suspicion or probable cause, you ask?

The footage, accompanied by an article at Ammoland.com, explained that the homeowner, in hindsight, felt that his privacy has been invaded and that he felt coerced into cooperation with the officers. The officers explained that they were part of a task force investigating potential straw purchases, which occur when someone buys a firearm on behalf of another person, who is otherwise unable to purchase directly. They had records in-hand, showing the homeowner’s recent purchases, and they said they wanted to verify that the man still had the firearms.

    NEVER talk to the police without a lawyer present.

    Tell them no, i will not discuss anything. Please leave my property immediately. If they persist without s warrant, tell them they are officially trespassing, then go inside and shut the door.

    Do NOT engage in ANY small talk or allow yourself to get angry and argue.

    TELL THEM NO AND TO LEAVE IMMEDIATELY.

  2. I watched this first from who it happened to. He had a you tube channel about trucks & guns. This seems to have happened right after he did a video about oil filter suppressors. He eventually moved out of that state. He did all the right things got a tax stamp for the oil filter and everything. This country is going to hell in a hand basket.

  3. Aren't there enough criminals around for these guys to follow up with and/or knock on their door? This is weaponization of a federal agency and they are hassling tax paying legal gun owner citizens! WTF.. go harass the freakin criminals and leave the law abiding gun registering citizens alone! They want you to register your weapons so they can knock on your door and proceed to deceive, inveigle and obfuscate..

  4. I would rather the cops do this knock and talk and attempt to get information rather than call up the swat team and come in guns blazing and shoot your dog. Knock and talks are good, people just need to know and exercise their rights. No doubt terminating the encounter could go bad for the homeowner in the short term.

  5. Ask them if they have the consent of the local sheriff. The one that they actually have to get permission from to conduct federal bullSh*t in his county. Chances are, they don’t. State cops do not count! They talked that guy into coming with them to seem more legit. Sneaky A** murderers!

  6. Demand to see a properly Issued Search Warrant ! Plain and simple , these Officers are out of line and Not following the Constitution !!!
    Send them packing ! Order them off your property until they Comply with the Constitution !

  7. I thought NICS background checks that are approved are mandated to be deleted after 24 hours, and are not referred to the ATF for investigation.

    THAT’S clearly why he was there… the cops assumed because he went to Philly, that he was selling them in Philly.

    As far as a knock and talk… I don’t think a reasonable person would understand that Federal Agents would conduct a simple knock and talk. It might violate posse commitatus, and it’s certainly a show of force that might confuse a citizen into believing that it’s not a consensual encounter.
    If the ONLY local, county, or state police showed up, my guess is that they wouldn’t make as much headway with people thinking that it was somehow mandatory because a Federal Agent is far more out of the ordinary than a cop coming by on some rumor he heard in town, and everyone is used to shutting their door in the face of local PD. The name ATF alone carries enough weight to make someone worry that this interaction and this guys report will follow them forever.

  8. On a ludacris level, isn't that like a cop pulling over a car, because it looked like the driver was going to text while driving?
    All the while, the phone is out of sight, in the console, and both the drivers hands are on the steering wheel.

  9. Another encounter i saw like this ended with threats to be on a list and then them coming back. Sounds like a threat of retaliation for exercising ones constitutional rights under color of law. Recorded on video.

  10. In this situation I would have told them to hold on, shut my door and call 911. I'd let them know I had a couple of strange men with guns at my front door, asking me really strange and concerning questions and just wanted some police to come out and see what they were doing.
    Any problems with that?

  11. I wonder how effective this method is for detecting straw purchases. How often do they go through the list of known guns, and how much manpower does that take? There's three guys for every event after all, from two different agencies.

  13. So these cops are trying to do something about illegal guns and simply asking to verify the guns bought, what a cheek putting this poor man through such an ordeal. It's idiots like you that put guns and stupid 2nd amendment rights above the rights of innocent people to survive living another day, if this guy is a responsible gun owner he should be more than happy to verify the weapons instead of making an issue out of such a simple request for no other reason than public safety. WTF is wrong with you, maybe if those guns were used to massacre ur family you no doubt would still shitcan the officers. 🤡😵🤯🚮

  14. The main question to ask is why does it take 3 cops to "investigate" or "verify" if the one who purchased the guns still has them in their possession? To me they were hoping for an arrest and used a show of force as an intimidation tactic to coerce the owner into answering questions they legally did not have to answer. They made an implied accusation of the owner making a "straw purchase" putting them immediately on the defensive and having to "prove their innocence" to the officer.

    If you own guns and some cop shows up to "verify" that you still possess that gun and they do not have a warrant, immediately tell them that you are not going to answer any questions and demand to see a warrant. If they feel they have a strong allegation then they need to get a warrant and produce said warrant upon arrival or they get nothing. Do not let them intimidate you like that. Make them do their job and do it the legal way and do not say anything that may incriminate you. For all you know they may have corrupt records and looking at the wrong name, gun serial number(s) and even address. Do not even give your name to them especially if you remain inside of your home and doing a video chat.

    The main thing is to demand to see a warrant and if they do not have one then stop all conversation and ignore any attempts by them to continue it. Tell them to leave and only return once they have a warrant they can produce.

  15. Last thing I am going to do if three cops come to my door and ask to see my guns is go grab them and come to the door with guns in hand. Insanity. Talk about a licence for police to shoot someone. I would just set up a zoom call with the officer on my phone, locked my door, and then take my phone to my gun safe and show them the guns in question. That way they are never in the same room with the guns, you are not worried about any confusion about intent and them shooting you for picking up your guns "in a threatening manner", and they can verify you have them in your possession in real time.

  16. TCRL, more visits are coming in 2023! The new Form 4473 will include a statement involving not purchasing to sale or dispose of the firearm that would constitute a crime carrying a penalty of more than 1 year in prison. Selling firearms for profit without a federal firearms license carries a penalty of 5 years in prison and a $250,000 fine.

    That means anyone privately selling firearms, and one could argue "trading up," for profit or benefit, are likely to start seeing visits after February 1, 2023. How can we confirm the plausibility of visits? They are also adding a section asking if you live inside or outside the city limits. The DOJ would NOT need to know this unless they were going to make visits!

    Where it gets twisted is if would be falsifying a 4473, trafficking firearms, conspiracy to commit, conspiracy to conceal, and if they wanted to…lying to federal agents.
