In a disturbing incident captured on bodycam footage, a 9-year-old student at Stenstrom Elementary School in Oviedo, Florida, was handcuffed by police officers in February. The fourth-grade student was reportedly throwing an aggressive tantrum in the school’s mail room, prompting school resource officers to intervene. Despite the child’s young age, the officers resorted to restraining him with handcuffs for a total of 13 minutes until he calmed down. The video has sparked outrage and raised questions about the appropriateness of using such forceful measures on a minor.

The family of the 9-year-old boy is now taking legal action against the City of Oviedo and the school resource officers involved in the incident. They argue that the use of handcuffs on their son was excessive and unjustified, given his age and the nature of the situation. The family’s lawsuit seeks to hold the city and the officers accountable for their actions and to ensure that similar incidents do not occur in the future. The Law&Crime Network’s Elizabeth Millner provides an in-depth analysis of the case, discussing the legal implications and the broader debate surrounding the use of force by law enforcement in school settings.

  1. This is never ok a child should not be handcuffed in this situation. They didn’t deesculate the situation with the cuffs he got more irate when they put them on.

  2. 9 year old child shouldn't behave the way he does. They need to throw away the lawsuit. The parents need to explain themselves why they have a child that behaves the way he does. The school needs to sue the parents.

  3. Co wy robicie to są ale dzieci porwane za pieniądze, 400 tysięcy z Polski przepraszam ale jest przemoc złamie ie rączki maluszkom

  4. That boy wasn't hurt and the cops didn't do anything wrong in my eyes. If his parents disciplined him this could have been avoided. That little boy said he's been hitting staff since pre-k…His behavior should have BEEN addressed.

  5. The officers should be charged with dereliction of duty for not rendering aid to someone in need and also for exaggerating the situation

  6. The real world doesn’t have ‘punching pads’ for people who choose to be violent. But, again, who am I to interfere with parents teaching their kids the skills they’ll need to be successful in prison.

  7. I mean it claimed him down and he went to the guidance counselors office so I think they did fine. They didn't take him to jail they put them ok him to claim him I mean he was kicking them and throwing stuff. Him getting handcuffs wasnt hurting it helped claim him down. It wasn't hurting him.

  8. Just to say, the parents are to blame, special needs or not the kid should not be acting like this. The kid must've heard swear words at home. The parents are very irresponsible, the parents sued for damages , the kid threw stuff, but yet he was throwing books so the school should be sueing. The parents are probably treating there child better then other people, thats why thare sueing instead of improving that kids behavior.

  9. He clearly needed to be restrained by some means, I think the cuffs were what they had available at the time.
What is the proper way to deal with such a situation?
