You may have seen the video of the 6 year old child being handcuffed in Orlando, Florida. It’s been making its way around the inter webs. I’ve actually researched this issue before, and there was a 2018 case on the handcuffing of a 10 year old here in the 4th Circuit in 2018. I briefly discuss the applicable law, and my opinion. I mean "can" they. Apparently. Should they? Probably not. Exceptions if you're in a knife factory and the child is acting aggressive.
Where is this cop today? I wouldn’t be surprised if he was hired at another department.
Unfortunately they can detain a child on school property if they’re a liaison officer especially. I’ve seen it. But generally it was for simple assault or public affray assuming they had a good lawyer. This case however, after having watched the video, the kid was nowhere near what I assumed he was going to be like.

A 5 year old stabbed another 6 yr old eye out.. what if that was your kid.. would you want the cop to arrest that child.. not until your child gets hurt its all good

I can answer that question for my child, NOPE, not without handcuffing me or shooting me for going full on silverback gorilla on you… Especially if you get qualified immunity, nope, I'm ten toes in on that stance…
It was a female child too, female officers are suppose to arrest females, you know so you don't appear to be a creep…
Making a child feel like a sex trafficking victim isn't any law I've heard of, child kidnappers don't even do that, they use candy because even they know how fragile a child thinks SMH
What happened to protect and serve ? As to hand cuffing a disabled 6 year old. I wonder if the roles where reversed and it was the police officers child being beaten with a disability ?

That will probably mentally scar that child for the rest of her life…. My question is, were her parents or legal guardians notified before hand , and were they given the chance to respond before the cops were called

That is an example of a criminal in action. The cop. If that was my child. He would be handcuffing me.

All I’ve ever read as far as the laws were broken down by each state, they have different laws on arresting children below certain ages. Not a good idea no but the current case law isn't enough to override the officers qualified immunity.

Well we all saw in the video that they can…the question should be is it lawful and I would hope it isn't lawful, most people in their right mind would not even think of doing this

In this case the school system made bad judgements. Other options to remove the child without restraint should have been looked at such as getting a counselor,teacher,parent or other qualified individual to assist in removing this child from the environment. I did see the video and the actions certainly will cause great distress and anxiety for this young lady. As for the officer he also could have tried other options but elected not to…
