The cop has an arrogant attitude to civilians.
He believes he can stop, frisk and demand ID and then arrest for obstruction, all without any suspicion of a crime.
It may be unconstitutional but he is not policing by consent, just roughing up anyone who crosses his path.
This useless so called officer blocked traffic in the oncoming lane and could possibly cause an accident. Illegally blocked traffic and assaulted the man. Violated his Constitutional rights and illegally detained him to serve papers. Police are out of control and out of touch with reality. Police are criminals with badges and guns. Abolish qualified immunity and paid administrative leave.
It's clear that cops take advantage of people being unsure of their rights and afraid that even if they know their rights, they're going to have their rights violated. This cop probably knows the difference between right and wrong, but doesn't care, because he will never pay any consequences for violating a citizens rights. He bullies and intimidates in order to get his way.

Mr. Jackson should file a lawsuit for the Fourth Amendment violation AND for simple assault as the cop touched the clothing of the victim. No Terry stop was warranted for "officer safety."
I the UK civil paperwork is not served by police ever. It is the job of a bailiff. The police can be present if requested but must be an observer only becoming involved if there is violence

The only question I have is why were the Police handing him a Civil Lawsuit? This is usually done by a process sever! I know I used to do it. There was never any problem such as this to do it right.
All Mr. Jackson had to do was to say "no, I'm not him." But since the cop was right, and he apparently did see him come out of the house, it makes Mr. Jackson look pretty stupid, if you ask me.

I see your point, John, and agree that this crosses the line (albeit barely) into a 4th amendment seizure. But in reality, I just don't see a court helping this guy get rich over it.
The thing is this is our fault. I keep reading comments about how could they let this happen? We let this happen, we allow these goobers to continue with their abuse of citizens, we allow their supervisors to sleep on the job and use taxpayers money to pay damages. We are of, by and for the people. It’s us that needs to change.
