  1. So, the open carry laws for a knife or gun (which is legal in Texas) are negated by people calling the police and saying they are scared! I don't get it. Is it because the knife is fake? If he had a real bloody knife it would have been okay? And I don't get why the police drew their guns on him, put him in handcuffs and arrested him, for either a fake knife or a real knife. The Michael Myers costume not only doesn't give alarm, it's amusing!

  2. Our neighborhood has a party around Halloween at the neighborhood park. People walk to the park dressed in costumes. One year I went as a viking with a 4-ft sword and an ax, another year as the grim reaper with a scythe. I guess I should count myself lucky I wasn't arrested.😂😂😂

I can understand and realize the concern especially if the view is from further away and they just seeing a masked man standing on the beach with a knife that is a safety concern for potential beachgoers and all so I don't disagree with police arriving but I feel like arresting should be a last resort depending on the circumstances because I feel like they should've spoken with the person especially if the person was peaceful and obeyed orders and such.

  4. I’m sorry, but what this man did was very poor judgement. To walk around in a public place with what looks like a bloody knife, how do you not expect people to freak out and call the cops? And it wasn’t even October yet, so how can you expect a reasonable person to know that it’s for Halloween? He doesn’t deserve an A.

  5. We're expected to simply know through osmosis every aspect of every law that has ever been written, however it's illegal to impersonate a lawyer because the average citizen can't be expected to study and retain the nearly decade's worth of study it takes to properly understand the law.

    Yeah that sounds about right.

  6. I’ll say it here again cops should be held to a HIGHER standard than citizens since they are empowered by the government. Qualified immunity is a built in guarantee they will be worse at their job because they can be.

    Walking around during the Halloween season dressed as MICHAEL MYERS and brandishing a rubber knife= menace.

    And Americans wonder why the world face-palms at them. Lucky he wasn't in Florida, he would probably be sent to ADX Florence.

  8. This is one that I think the cops were okay on it due to the fear his prank caused and many calls in to their department. Lawyer or not, the unusual behavior seems odd of a grown adult. Needs evaluation.

Certainly interesting that citizens are expected to know the minutia of law, when, just due to the overwhelmingly large bodies of laws alone, even seasoned attornies are not always on the same page with regards any given action, and its lawfulness or illegality. Consider the amount of information in just the federal tax law.

    The idea that persons "are presumed to know and understand the law, except minors, persons who lack mental capacity to contract with others, and, in criminal cases, persons who are insane. There are, however, a few other rare exceptions to this general rule." certainly seems fallacious, especially when officers ostensibly trained in the APPLICATION of that law, so frequently make mistakes.

    I would submit that the point is to keep the public literally in the dark, as it benifits the legal profession in many ways. "QUIS CUSDODIET IPSOS CUTODES?" The legal profession? The judiciary who certainly make their own mistakes, especially at the levels of municipal courts, and district courts. Rarely does a judge affirmatively intervene for an arrestee in a municipal court, as their main purpose is to generate revenue for the courts.

  10. This lawyer lives in fantasy land if he thinks that that is in appropriate thing to do. I wonder how many people had to alter What they were doing or where they wanted to go just because he was there. He used up valuable police resources during a time of emergency, What a moron!

  11. As a tropical storm approaches and people are trying to ready their homes and families for possible power outages etc this dope decides to pull a prank like that. While I appreciate that it is his legal right, there is no way he felt this would alleviate the doom and gloom and he stated. While the officers may have not used a lot of common sense in charging him, as an educated attorney he used even less.

  12. If the cop can interpret any situation any way they want. They can opress all your rights, any time.what the hell are they gonna do on holloween. Theae efen people make me wanna puke,. Its cleaarly about money, and ticketing for profit.Canada might be worse then the states. Im definatly seeing a major abuse of authority inare country.

  13. Honestly, I think the Officers did their job correctly, and honestly deserve a little higher grade then a C-, in todays age its difficult to tell if someone is sane or not, even if they are dressing for Halloween prank videos.

    Sure he was in his right to dress up, but that doesn't mean that a Officer doesn't have probable rights to detain that person for however long they wish to do so, I know that may sound old school, but bigger cities have the highest suspicious activity compared to a small town or small city.

  14. Police wear their costumes all day and night. They go around scaring people with actual deadly weapons. A majority of them are indeed deranged and no doubt guilty of disorderly conduct at some point or another.
