  1. This is the first time I’ve heard that trespassing requires “the entire body“. How many times have we heard that if someone puts “1 foot on the property” of a restricted government property they will be trespassed? Sounds like Texas law is contradicting current case law? Can you use “illegal search” like you can when an officer puts his hand in your car?

    The correct grade should be D+

    Either they violate his rights or they don’t

    This whole situation was awful.

    Express the authority that grants you the right to enter the home – articulate it as well as you would in a report. Make sure he understands well

    Escalating does…what, exactly?

    “It’s quicker to just enter”
    And it’s also respectful to explain themselves

    “Let us in because we got a phone call” doesn’t articulate the reason why they’re GOING to go in regardless of his rights

    What did they accomplish by putting their foot on the door?

    “He’s gonna finish her off while we stand around!” 😅 just astonishing how people seem to think there’s a new constitution saying “your rights go out the door upon an officer’s imagination’s flight”

  3. Should be an F @AuditTheAudit. How difficult is it to get a warrant? Is it more difficult to do things by the book? Yes, but are there checks and balances to protect free citizens? Absolutely. By your example any LEO can say they entered home and simply say they were there to prevent a possible DV situation.

  4. “I do not consent to you entering my home, I’m going to close the door now. My goal is remove you from my private property to exercise my 4th and 5th amendment. My goal is not to cause you any bodily harm, so I suggest you move your foot . Good day” slowly closes the door and pushes hard to move his foot with the door

  5. These cops are idiots. With their logic, all a cop would have to do so walk away from the scene, place an anonymous tip to do a welfare check, and they could enter whatever house they want. That’s ridiculous.

  6. What about if after this a child was abused because they left without investigating? Would it be that bad then? Because Cops being persistent is very often the reason someone breaking the law is stopped. Not saying this was going to happen but it's a situation that happens. Perps telling the cops to go away.

  7. They pushed him aside and stormed his home. When it was clear they were in the wrong house did they apologize and promptly leave? No, they pointed to a mess the dog made, tried to call it blood and accused him of abusing his son. That gets a B- from you? No they didn't try to do some bogus drug investigation they only accused him of abusing his son. So that makes them stand up guys because they only want to help the woman that did not exist Well, you get an F.

    You confused the crap out of this situation.
    cops get a F based on what you stated.

    A call just in it's self does not give them the legal right to enter a home without a warrant. He held the door open enough times for them to see there was nothing wrong and they could see the child was not harmed.

    In my opinion they had zero evidence to indicate any laws were being broken and no cause to enter unlawfully.
