  1. I'm not understanding why there seems to be such a difference between a prison parking lot and a county jail parking lot? Publicly accessible areas are publicly accessible areas that are publicly accessible to the public. I also don't understand why you yourself are not backing that up? There's been several cases where you've agreed with a person being in a police station parking lot and or a county jail parking lot being free to exercise their constitutional rights but in this case you are licking the fucking boots of those cops.

  6. 1st amendment auditors! Make sure you read and understand the laws before going out. Not understanding that trespassing doesn't require a sign and that not all roadways are open to all the public could have ended quite poorly for this man and been a massive step back for the auditor community.

  7. Ummmmm key words here. Prison…… b+ is nicer than i would give. Like all power to the guy. But yeaaaaa as a citizen it would make me want to interfere and report anyone filming a prison without the prisons knowledge. That’s dangerous footage to have. Im sure a gang or crime circle would love that footage. I support an audit but thats a prison. There is a right way to keep the public safe and that footage can be harmful. Its cut throat but true.

  8. Please come to the country jail here in Gulfport MS called Harrison county jail, it’s a very corrupt system here, I e seen it with my own eyes and have dealt with the abuse of the police. Trust me they’ll act insane if you video anything on the property!

  9. I think Audit the Audit is misinterpreting these case laws here. Firstly, "media" usually refers to larger productions. Not citizen media with a cell phone. I'm pretty sure this channel even pointed that out in a different incident. Secondly, if that road has a specific purpose for the prison, there needs to be "restricted access" signage posted since it is publically funded AND more importantly that road is used by the public to visit inmates at that prison. Matter of fact, given this prison's heightened reaction to this one man's presence, there should be a guarded gate at the top of that road. Otherwise everything inclusive of the parking lot should be publically accessible to practice 1st amendment rights. The public does transact business there (visitations), so I fail to see how this prison gets to be treated like the Pentagon without any obvious visible restrictions or road gates. I give ATA a C-.

  10. The reasonability to restrict open video can be determined by the capability to film secretly, and what consequence would be possible from them publically publishing that video. If that video would not be punishable by law, then restricting open video in itself is unreasonable.

    Tresspass can not be issued as a means to circumvent the constitution. So… signs relate to all where issued verbal notice is direct to the individual. He confirmed the unconstitutional nature of the Tresspass.
    On public areas, it matters, because private areas CAN Tresspass for any reason including recording alone.
