  1. I don’t agree that the fifth amendment only applies when there is custody. There is nothing in the amendment that limits it being in custody. If the police want to “chat” with me, I can invoke my fifth amendment right and not talk to them.

  2. Don't ever explain yourself or try and prove your innocence to a police officer. They're not your friends. And your lawyer will thank you.

  3. I am not an attorney but I don't think it's in your best interest to remain completely silent from the beginning.
    IMO, you need to say "I am exercising my constitutional right under the 5th amendment to remain silent" then don''t say another word.
    I read about a case where a man was speaking freely during a police interrogation then stopped talking when the interrogation began to implicate him in the crime. His refusal to speak at that point in the interrogation was used in court as evidence of his guilt and higher courts agreed his silence at that point was not protected by the 5th amendment.

  4. 9:33 hard to articulate reckless in a parking lot because in Florida the statue requires 2 or more moving violations simultaneously, but culpable negligence would be easy to articulate.

    Regardless the passenger has reason to file a lawsuit and should be an easy one for the court to decide. 🤑🤑🤑🤑

  5. 7:00 this is true in Florida but pertaining to being suspected of a crime or if they smell the odor of cannabis (now everyone is detained), or a burglary suspect vehicle. But as far as traffic violations, crashes, the passenger was always free to leave and does not have to provide ID. Unless something has changed since I left towards the end of 2019.

  8. Guy loses control of vehicle when transmissipn blows, cop makes up a story to secure an arrest and projects his lies on his victim. Sounds like policing alright.
