“Lackluster” Gets a Fraudulent Copyright Strike for Dashcam Footage and Now We Sue – Everything Law and Order Blog

One of my favorite YouTube channels, @LackLusterMedia received a fraudulent DMCA takedown notice from KARK TV station in Little Rock, Arkansas for a viral video he posted about a pregnant woman who had her car flipped by a “PIT” maneuver by the Arkansas State Police. He had obtained the dashcam footage directly from the ASP. However, KARK had their own coverage and YT video using the footage, and claimed ownership of Lack’s video. This caused it to be pulled in the midst of spreading like wildfire. So instead of 400k views, it is projected that it would now be around 2 million views. They waited 4 days to withdraw the fraudulent strike, which effectively killed the virility of the video.

Now I’m representing him and plan to make them pay…… I’ll explain in the video.

  1. It would be so great for these to be updated. The cop is still on the force – it was justified per existing policy. Woman sued but no money terms made public and generic … The police will supposedly change the process.

Further to the video, but concerning content of the KARK4 TV broadcasted video, if I may comment, it is pure propaganda how it was biased and speaker was raising the cop to the level of the hero and exposed his photo, like it was ultimate act of national importance and security. I find that actually harmful.

  3. I remembering seeing this on his channel. This cop has NO heart. No conscience. Just listen to how calm and seemingly nonchalant his voice is before and after the flip. How can anyone do this to anyone who is clearly signaling to pull over where it is safe.
    As for YouTube and the news channel— they aren’t acting in any form of good faith. This is simply part of the machine that protects the guilty.

  4. I watched a video a while back where a pro. photographer took a picture of I think of a tree near the white house. She then donated it to the white house or some gov. body. Later she uses that photo on line and gets a copyright strike . She sues who every put the claim in and looses. The judge ruled that any can copyright gov. photos or something to that effect. I suggest looking into it.
