Marine Veteran Charged In NYC Chokehold Death — Everything We Know So Far

Marine veteran Daniel Penny has been charged with second-degree manslaughter for the New York City subway chokehold death of homeless man Jordan Neely. Penny decided to restrain Neely after he allegedly started threatening people onboard the train. Now — politicians and celebrities are raising money for Penny’s defense, calling him an American hero, while others are calling for justice. The Law&Crime Network’s Jesse Weber breaks it all down with former Watergate prosecutor, and former assistant United States attorney for the Southern District of New York, Nick Ackerman — who weighs in on the strength of the case.

  1. How is this a difficult case.. we don’t need witnesses if he didn’t even touch anyone how could he be a threat big enough to constitute literal murder for what? This is so yuck.

  2. This USA does not support its soldiers that wold die for their country. They live on the streets they suffer depression they live lonley lives and America does not care! Free Penny!

My issue with the case is, if the guy was trained to subdue and how to/how not to cause someone's demise, why didn't he keep the attacker in a subdued position until the piloce could take over while lessening his grip as not to cause brain damage or ends him? He didn't strictly have to choke him out if he had already had him on the ground away from others. Best case scenario, manslaughter and he didn't mean to cause injury or demise, worst case scenario he decided that ending the guy was his job and purposefully ended a guy having clear mental health issues.

  5. Penny is a HERO for stepping up to PROTECT the train passengers from this man who many of them perceived him to be a THREAT!! Actually, I believe that the DA responsible for allowing the “alleged victim” to be freely walking the streets after having 42 PRIOR ARRESTS, including violence and assaults, should be the one on trial being prosecuted!!

  6. No it is not a difficult care, did Neely said he would kill people and not mind to go to jail. So is intent was to kill. I just want to USA law makers, are your mother allowed to defend herself against a man that said he will kill her? It seems law systems is sucks in USA.

  7. A threat a homelessman with no weapon. Its a marine shiwing off he should be ashamed of himsrlf ..diff. no hero more of a zero. I have 5 marines in my family and they seen worst and did nt kill no one. Oh and my husband was a pilot in the airforce in Veitnam .

  12. sorry he did use a choke hold that killed someone. that is wrong end of story. You cant sugar coat a wrong. you can subdue with out causing death. No reasons can justify this. This mans history doesnt give anyone a right to kill someone. restrain without harm. And with all those people allegedly there, there was no excuse to maintain the choke hold..He was wrong and should get jail time

Do you guys not think a combat veteran marine might also be mentally ill? Just because he has made better life choices doesnt mean hes 100% sane.

  16. He definitely meant to kill him because you never hold someone in a choke hold for that long, it's not even necessary, Neely flailed his arms for him to stop and he still didn't stop. I seen the look of murder in his eyes, he's trained so he knew it was unnecessary force.

  17. the media keeps showing that man as a young dancing michael jackson impersonator SO DECEPTIVE, that was over a decade ago , neely was a deranged psycho with a very long violent criminal history , HATS OFF TO THAT MARINE THAT PROTECTED LIVES ON THAT TRAIN ! ! ! ! !
