  1. The street plan clearly shows he was parked on a grayed piece of land that was not a numbered plot of land belonging to someone – it appears to be a visibility splay at a junction likely maintained by the local authority, or their easement as all easements are colored gray..

  2. The chain link fence is on the property line. A professional fence company almost always installs them that way. If there was a recent land survey, there will be a white wooden stake at each property corner to demark where the survey marker is in the ground. Recent markers will be a rebar with a plastic cap that has the surveyor and his registered state number on it. An older one is usually a steel pipe. Compare the fence with the map. They are the same. High traffic arterial roads have really wide rights-of-ways, well beyond the edge of pavement.

  3. The officer never stated why he was there other than he didn’t know who owned the property and Josh was illegally parked, which isn’t an arrestable offense I would think. Just another tyrant office who thinks he has authority over us.

  4. Something of great importance is being missed here. The remedy for trespass is to first request you to leave the property. Not only wasn’t he asked and given reasonable time to leave but he denied his offer to move the vehicle in which the subject clearly offered immediately!

  5. Being arrested, handcuffed, and denied your freedom is bad enough, but when it is done illegally it should be punished. The cop can keep his job, but should have to pay a fine out of his own pocket to the person he abused. If this happens a third time, then you are out.

  6. It seems that almost no cops anywhere understand trespass law.

    It also seems apparent that this cop didn't care what trespass law was and didn't bother to check, they almost never do.

    Hope this man gets justice. One hopes that the judge is better aquatinted with the law than the cop is.

  7. Wow… the more videos I watch, the more I see how desperate departments are to hire LE Officers. Do they really have any training, other than arresting for trespassing and interfering…
