In this episode of Crime Watch Daily Updates: Diane and Tex McIver were no strangers to socializing in powerful social and political circles in Atlanta. But with great power comes great responsibility, and Tex McIver was about to find that out the hard way.

On September 25th, 2016, Diane, Tex, and their friend Dani Jo Carter, were driving back to Atlanta after spending some time at the McIver’s horse farm. Dani Jo was at the wheel while Diane sat in the front and Tex in the back. During their travels back into Atlanta, Tex asked Diane to hand him his gun.

His reasoning behind wanting the firearm changed over time. At first, he said he was nervous about Black Lives Matter protesters in the area and didn’t want to get carjacked. Then, he claimed he was worried about the amount of homeless people nearby.

After Diane handed him the gun, Tex fired and shot Diane in the back. Dani Jo drove Diane to a hospital, where she died from her wounds. He claimed he fell asleep and accidentally pulled the trigger.

Tex was indicted in April 2017 on several charges. He also was accused of influencing a witness.

He went to trial in 2018, and prosecutors argued he killed Diane for her money because he was going through some financial hardships. In the end, he was acquitted of malice murder, but convicted of felony murder, aggravated assault with a deadly weapon, possession of a firearm during the commission of a felony and influencing a witness.

A judge sentenced him to life in prison with the possibility of parole.

Tex’s attorneys appealed the conviction and argued that the judge who presided over the case did not inform the jury they could have convicted Tex of involuntary manslaughter.

In June 2022, the Georgia Supreme Court overturned Tex’s conviction. However, he is still behind bars and in October, a judge denied him bond. Prosecutors reportedly plan on retrying him.

  1. 🧠 ~ The people in the comments are crazy. And the jury on this case was beyond foolish. Based on what they found Tex guilty of it actually means that they decided that he did NOT purposely try to kill her, but they convicted him a felony murder which means that he did shoot her on purpose but he didn’t want her to die he just wanted to injure her. And that’s the most ridiculous conclusion. The truth is the jury probably really doesn’t think that, but that’s what they found him guilty of. They found him not guilty A purposely trying to murder him, the guilty of purposely harming her, and since he purposely harmed her in their eyes they also found him guilty of felony murder. But you really think he shot her and just wanted to hurt her without killing her, that way he would have medical bills to pay and she would still be alive? I mean it’s foolish.

    So we do need the jury system as a safeguard against tyranny, but the jury system is flawed from head to toe.

    And as far as people believing that Tex is guilty, I don’t see it that way. But I’ve not watched the entire tryout like I have with many other trials. I don’t know if the entire trial was broadcast or not, but I did watch a daily podcast that summed it up every day. And people say you don’t fall asleep in a bad neighborhood nor can you pull a trigger when you’re sleeping. I completely disagree. People who are very into guns and have a concealed carry permit will carry guns all over. When I was 21 I was just like them. There’s several times I would walk into work with a gun strapped on my hip and not even realize it until I sat down and I felt different in my chair, or sometimes not even then, sometimes I would wait until the gun hit the armrest. Then I was very worried. Because I was caught with a gun in my business I would’ve been immediately fired. A lot of guys carry around a gun like they do their genitals, and I think it’s basically just as important. Lol. And as far as in falling asleep, they were in a moving car that was locked. While Tex was not smart it doesn’t mean he murdered his wife. I don’t see how anybody can believe that he purposely did it beyond all reasonable doubt.

    And as far as him accidentally pulling the trigger, I’ve been asleep and all of a sudden I jerk for no reason. Or I woke up because all of a sudden I have slammed my mouth/teeth down and the pressure of the bite has woken me up. And sometimes I actually bite my tongue also. It’s happened a few times at least.

    I think people are just big into making snap judgments based on the information they happen to know. And confirmation bias is huge among humans. I actually think I’m pretty good at recognizing my own confirmation bias, but who knows.

  7. I'm not saying it is by any means, so please don't take it this for what I actually think. More like a hypothetical, but what if it was an accident? Like just some freakishly weird accident? A lot doesn't add up for sure, but could you imagine? I could understand an accidental discharge. In fact that happens more than these " gun " experts like to admit. What I don't get is the long drive to the hospital. That makes zero sense.

No documentaries for years now! So why does it even still got the same name. At least change the name to: True Crime Daily THE PODCAST instead of True Crime daily! This channel has nothing todo with crime documentaries anymore UNFORTUNATLY!

  10. IF Tex was so worried about the homeless, etc. that he needed the gun, how the heck could he be relaxed enough to fall asleep? and If He was passed being worried, then he would put the safety on and put the gun down on the floor or somewhere. He's a lawyer, born to lie!
