WV Civil Rights Lawyer John Bryan discusses search warrants, due process issues and other constitutional law issues that are popping up recently – both in West Virginia and nationally. Also, discussion of the separation of powers doctrine, some pending civil rights cases, as well as some still in the works.

Also, I did a TV interview on this today, which seems relevant: Can your employer force you to take a vaccine?

Freedom is Scary, Episode No. 42.

  1. Hey John, would you be willing to talk about West Virginia brandishing law and other laws that are applicable to CCW in WV? I'm looking to move there and would like to learn about these things I'm having a hard time defining what WV considers to be Brandishing.

  2. The state of emergency will never end . 2009 report of a covid virus from China said it had come from wet markets and that it will happen again . It happened again . So why this insane lock down now ? Why the new untried vaccine . I'm very pro vaccine . But this is a RNA vaccine , and has no relation to any vaccine in the history of humanity . I don't know what's really going on here . It's all very strange 👀👀👀👀👀👀

  3. ROFL…..Why can’t the WV legislature step up to the plate and do their jobs? I’ll tell you why because WV keeps electing tyrants like (D)Joe man-chin and (D or R who knows) Jim justice. Start electing 100% constitutionalist If you want a government that represents you. It’s really that simple.

  4. re vaccines, look at Methloquine, An anti malaria drug,, wasnt tested and was given to soldiers. turns out it had one tiny side effect… Made you suicidal and soldiers were killing themselves.. so Yep you want certainty

  5. classing an AR as something to cause fear, is unfounded. Especially to people who want one rifle for all the family, to handicapped, to those that like to mod something to suit oneself. The number 1 caliber used is a .22LR even. Denying modern design and styling is like saying Hell no we dont want air bags for gods sake.

  6. As far as masks scientifically speaking it's been shown to deprive you of 60% of your oxygen and it's also keeping for lack of a better term a petri dish of bacteria on your face at all times and just my opinion it decreases your ability to acquire your own immunities to viruses

  7. Federal Civil Rights Statutes:

    18 U.S. Code § 241 – Conspiracy against rights

If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same; or

If two or more persons go in disguise on the highway, or on the premises of another, with intent to prevent or hinder his free exercise or enjoyment of any right or privilege so secured—

They shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, they shall be fined under this title or imprisoned for any term of years or for life, or both, or may be sentenced to death.

18 U.S. Code § 242 – Deprivation of rights under color of law

Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

Words are the central nervous system of the human collective. Spread the words far and wide. Research and critical thinking are an effective shield against ignorance. Knowledge is the strongest armor we can wear in the journey of life…

  8. As Trump's lawyers pointed out during the trial, Trump's use of the word "fight" was in the context of encouraging the people at the rally to urge their congressmembers to FIGHT for the people. i.e., do the work of the people.
Too many State legislature are mostly full of people that the party establishment either has dirt on or has made promises to — so they will all follow the party narrative.

  9. "Can your employer force you to take a vaccine?"
    Physically and directly, no.
If it is a non-government employer and hires only by at-will contracts, then, effectively yes in that, you take the vaccine or else you are terminated. :-0)

  10. Capito was one out of six republicans who voted for Mayorkas. Many people in our country are calling her a traitor to American patriots. If she doesn't want to represent the people who employ her and our constitution, she should stand down and we will find someone who will. What do we do to make our legislation have a conscience again and find the courage to do their job?
