[UPDATE: Lawsuit Filed: https://thecivilrightslawyer.com/2020/09/15/filed-bridge-cafe-bistros-federal-lawsuit-against-the-w-va-governor-and-putnam-county/ ]Enough is enough. On Freedom is Scary, Episode 13, LIVE on Youtube and Facebook, I will discuss the fact that the Governor of West Virginia has left me no choice but to file another lawsuit. This time I’m filing in federal court, on behalf of a restaurant who was on the receiving end of our Governor’s tyranny, via his local health department secret police. It’s been proven that lockdowns and other governmental tyranny doesn’t work.
Even assuming it was constitutional, it doesn’t work. The virus is/was going to take its course. Where the lockdown measures were most tyrannical, the virus spread at the same rate, or even worse. Then there’s the unintended consequences and side effects of keeping people locked down, and destroying their small businesses, which is the reason why we weren’t supposed to attempt lockdowns in the first place.
Update: Today a federal judge in the Western District of Pennsylvania issued an opinion striking down the Pennsylvania Governor’s order closing “non-life-sustaining” (i.e., non-essential) businesses, as well as the order restricting large gatherings. It was a great opinion, and great timing as well, since we can now incorporate some of it into our federal lawsuit against the West Virginia Governor. It’s not binding in any way in our federal courts, since Pennsylvania is in a separate federal circuit. But it will be great guidance for the Court, and it also incorporates some of the federal rulings in Kentucky, which clipped the wings of their tyrant governor. A full copy of the 66 page opinion can be found here:
As for efforts at fighting tyranny in West Virginia, I will be filing a lawsuit on behalf of the Bridge Cafe & Bistro in Putnam County, West Virginia. You may recall their Facebook Post expressing their First Amendment protected speech. This social media post resulted in the Putnam County Health Board (they’re located in Hurricane, West Virginia) threatening administrative closure, for which they physically inspected the restaurant twice for mask compliance, and then charged them for it. They were dragged through the media, and through social media, for the content of their speech. Threatened with closure if they didn’t change the content of their opinions, and comply with the unconstitutional “Mask Mandate,” they had no choice but to comply. See screenshots of the social media at the link:
We’re suing in federal court for First Amendment retaliation, under Section 1983, and we’re also challenging the constitutionality of the “Mask Mandate” itself, as well as the “Stay at Home Order,” as it applies to this restaurant and the family who owns it. I’ll post the Complaint as soon as it’s filed. Due to the great timing, we’re now incorporating some of today’s ruling out of Pennsylvania.

I am enjoying going back through your old videos. I knew that you had worked for the DOJ until going through these.
The gun laws are interesting and law enforcement should enforce them correctly.
As a Brit I personally don't think that guns should be a thing but as a mechanical object they are fascinating. I would love to have one to experiment with in the same way as I love my 2 stroke moped, even though it is an example of the worst 1980's moped that was available Tthetime.
Here is the problem "administrative law" … Rules, regulation, Licensing etc… We are a "Constitutional Republic"… "Private Property" is private for a reason… This is the bed rock of our Nation… "Administrative Law" seeks to strip everyone of this fundamental right…
It won’t work when the connection is easily manipulated by nefarious technocratic who use cyberspace for harassment.

Your compliance gives the power over you. Do not comply.
Well I know in Fayette County, the kids still are "in home" learning. I know my child's school has told parents that they are still working on getting kids school provide devices and then turned around and told parents via Facebook (and I guess word of mouth) that if your home doesn't have internet to please call your child's school. However when I called the Fayette County School Board I was told by a lady there, that one the Virtual Learning had a cut off date of July 31, 2020. (To which most parents had no clue about the cut off date). Then the lady told me that my child could be put on homebound only if a doctor states why and how long. She then told me that the other option was Home Schooling, which is when the parents school their children however those children will not graduate with a Fayette County Diploma and that the parents would write their children's diploma (however she then said that if you chose that option that she would recommend those children to get a GED as well because some people wouldn't accept a Home Schooled Diploma.)
I was involved in a "karen incident" last week while shopping.
OSHA is an interesting source concerning the wearing of masks.
We should all be in the little town of war West Virginia
Yes. Freedom is scary.
Know what’s scarier?
Tyranny. Tyranny is scarier than freedom.
Will we still need to write in S. Marshall Wilson for Governor? And do I have it exactly the way it needs to be written?
The first thing they said when this virus showed up was not to put your hands around your nose and mouth because this is how you get the virus. Now the government wants to force me to endanger my life by forcing me to wear a mask that I will be constantly adjusting in turn making me to keep my hands around my nose and mouth.
Can the government force me to do something that endangers my life and safety?
