A Georgia man is being retried for allegedly shooting and killing his friend, leaving her body in a park. This is the second trial against Austin Tybre Ford, 22. A judge had to declare a mistrial on May 1. Jurors convicted Ford of theft by taking, and one count of concealing the death of another, but they deadlocked on charges of felony murder and aggravated assault. They could not agree on whether or not he killed Tori Lang, 18.

  1. I feel for Tori’s family! I can’t imagine what they must be going through with a 2nd mistrial! I feel like the ME was a huge deterrent in the jury reaching a guilty verdict. Now, that being said and if I’m completely honest, (and I hate to say this) I feel as though whatever the issues were between the family and Tori also played a part and obviously her depression and suicidal ideations, whether or not they were passive, or active. In her journal, it sounded like the Aunt kicked her out of her house and there was mention of homelessness for a period of time, I’m not sure how long. Also, not having money for things like insurance for her car and someone mentioned issues with the father coming home intoxicated, not to mention issues with her mother, but I only remember Austin talking about that, so I don’t know how truthful that was. The other things I mentioned came from Tori’s actual journal, so I tend to believe those more. Anyway, I say all that because, when the family testified, the picture they painted was completely different from what Tori expressed in her journal, so it just makes me wonder where the actual truth lied….as the saying goes, “there’s your side, their side and then the truth lies somewhere in the middle”. I feel like that definitely applies in this case! That being said, part of me wonders if the parent’s guilt is so overwhelming because they feel like they should have done more to help Tori, that it becomes hard for them to really see what might have happened to Tori. However, don’t get me wrong, I still feel like Austin was absolutely at fault for SO many things…..like who tells your best friend to just leave and go home when they come to your house with a gun in their possession, that you see, but you give them some weed and send them on their way. (This was the first time Tori came to Austin’s house)…..how do you not call her mom at some point, or the police? There are so many things he could have done and of course this is if you believe he didn’t shoot her, because if you believe he shot her, regardless if she asked him to or not, that’s just a whole other issue! I’m not sure what really happened, sometimes I believe he did shoot her and sometimes I believe something else could have happened?!? 🤷🏽‍♀️
    I just think it’s a sad situation all the way around!

  2. They absolutely proved it. If his account of what happened actually matched the evidence I could see him not doing it but he lied and lied. His actions are also of a guilty man. This guy is guilty. So sad. I think they got into an argument and he killed her on accident. Even if he assisted, that’s still murder.

  3. If the state decides to drop the charges, will they be dismissed with or without prejudice? I'm wondering if the state could retry him if new evidence will ever be found.

  4. The defense has done a great job. But he lied a lot. He got rid of the car, weapon and phone stuff. His story doesn’t match M.E. She said she was laying down. He said she was standing. Someone is wrong. But if the ME is wrong, the evidence points to him imo. If the ME is right about her laying down, the. there is doubt. This is just bizarre. But the fact that he lied so much and his actions just scream guilty.
    But the evidence is hard to imagine someone laying down and doing this.
    If I’m being real, I think the M.E is wrong and he did it. She wasn’t lying down. Science is flawed all the time. I just don’t think 100% she is right. That’s the only evidence that creates doubt for me.

  5. i feel the state did not prove their case beyond a reasonable doubt. if he was being charged with failure to report the incident or providing medical assistance, it would be guilty but they did not prove murder

  6. If you believe the ME, the victim had to be laying down when she was shot.
    If you believe the defendant, she was standing up when she shot herself.
    That's the problem I had with both of them. Was the ME wrong?
    OR was the defendant still lying about her standing up when shot? If he is lying, WHY? It really makes him look guilty, then.
    I think the ME was wrong on this point. Though, I also think the defendant probably shot her, in that case.

  7. They need to do a better job emphasizing 2 points. 1) Bullet casings being ejected is not totally random. Yes, distance and exit angle varies widely. That being said, there are locations that a casing cannot be based on gun orientation. A gun fired with the grip horizontal,as it would be if she pulled the trigger with her thumb, cannot eject a casing in the direction that they were found. 2) if defense is going to emphasize the gun being in that void in the pool of blood, then prosecution should emphasize that the recoil of the gun if fired by her would physically have to make the gun land further away from the head than 10-12 inches. It cannot recoil forward.

  8. The state can't prove he killed her, and the state has the burden of proof. The evidence is the evidence. And requiring a speedy trial willl mean the prosecution will not be able to "FIND" more evidence. To try this case for a third time would merely be an ego move.

  9. Sad that there's always a few that can't put 2 and 2 together & get 4. I bet they're stuck on the M.E. not being able to discern manner of death from the body. But every other piece of evidence points right to the defendant.
