WATCH LIVE: ‘Take Care of Maya’ Trial — Kowalski v. Johns Hopkins All Children’s Hospital — Day 27 – Everything Law and Order Blog

The family of Maya Kowalski, the subject of Netflix’s “Take Care of Maya,” allege that a report of child abuse from Johns Hopkins All Children’s Hospital led to Beata Kowalski taking her own life. The Kowalski’s are suing doctors, the Department of Children and Families, and Johns Hopkins All Children’s Hospital for $200 million dollars in connection to Beata’s death. According to court documents, the child abuse case against Beata was pushed forward after Maya’s physician confirmed her condition, complex regional pain syndrome, was not the fault of her parents. During the time Beata was separated from Maya, she took her own life.

  1. Trying very hard to stay neutral but finding it very very difficult 😮.. I’m finding it hard after watching the trial ( post verdict) to understand how the plaintiffs won. Admittedly they didn’t have access to the things that were not allowed into evidence. I’ve yet to see the last two hours of today and whatever is left of the trial… but I don’t know. 🤷🏻‍♀️
    I so wanted to believe the plaintiff, because I was almost in a similar predicament with my second eldest many, many years ago but at the same time I don’t want someone to win, when their case wasn’t legit.

  2. In general I have issues with experts who are "chart driven". If you have 0 independent recollection of a patient and are simply relying on notes and reading it into the record… what value is there? that could be any patient, and clearly they didn't make a lasting impression so what value are you adding to the testimony?

    The defence used SO many chart driven experts and experts who never ever laid eyes on Maya (simply read others' notes). You CANNOT truly grasp a person's pain, suffering, or treatment course that way.

    1. Does the evidence reflect that there were multiple reports to DCF?
    2. Did Teppa-Sanchez call Dr. Sally Smith before any calls were made to DCF?

    I feel like the experts answer wasn’t in line with what I’d heard previously maybe…

  4. All of the defense's witnesses keep commenting on how many times Maya said she was in pain but how they didn't believe her. (Summarizing.) So Maya should have gone through life screaming to be believed? Because when she was supposedly screaming, that wasn't believed either. Really sick of hearing these witnesses all say the same thing. Group think is a thing. And this is why I don't like doctors. They do NOT listen!

Man, Dr. Hugh Windom, MD in the third-hour talks like some doctors are said to notoriously write, —- almost unintelligibly! — Was the doctor actually answering questions, or just incoherently-mumbling? —- If it was not for transcript, my nickname for him would be "Mumbles"! It would be near tormenting, to have to listen to him give a lecture!

    I had to struggle to understand his communication, even with the print.

    Also, something about his demeaner, as with a few others witnesses during this trial, that decidedly turned me-off! — A sense of arrogant indifference, perhaps.

    Some persons, and doctors may get to vain: too big for their britches.

  6. Man O man, that "Guardian ad litem" woman, something about her really turns-me-off big time! — I bet she is a Democrat. — Seems even the attorney found her demeanor annoying!

    Moments she flashes smiles like juvenile in schoolyard, did not help my less-than-positive impression of her!

    Somehow, I don't think she actually did have Maya's best interest at heart. — And further, my unprofessional estimation is —– she should never be allowed to play advocate for a vulnerable young person ever again! (period)

  7. Isn't that something? Someone that claims she has no life and who is so modest but yet that is NOT a modest way of dressing especially when in public. This just goes to show once again what a LIAR and manipulator she is. That is right I forget she is her mothers daughter! Hopefully when she has a child she doesn't repeat what was done to her!!! Keep your eyes open for MBP Part 2.

  8. evidently there's a still common notion amongst paediatricians and pediatrics that Functional neurological disorder and complex regional pain syndrome are one in the same, hence recommending the same treatments for FND, cognitive, occupational and physical therapy…without medications. Basically they just don't believe in CRPS.

  9. My biggest question today is – why is the plaintiff side objecting to "standard of care" explanation?? Shouldn't we all know ( especially the jury ) what the standard is, like a baseline??

  10. When plaintiff side went, i was swayed toward their side, but the defense has done a great job at creatinf doubt, which is their job!! At this point, i wouldnt be able to award plaintiff much. Im not sure what the jury is specifically to decide though

  11. Finally, here, the lawyer is making some points. She had to have been instructed to report on pain and probably encouraged to point out instances where Maya was not in pain. Otherwise why would she keep commenting on it. That should not be her job.
