But recent arguments in front of the federal circuit appeals court by two cop watchers could bring that precedent to an end. PAR examines how the actions taken by police in Lakeland, Colorado, to prevent 1st Amendment activists Liberty Freak and Eric Brandt from filming a seemingly routine traffic stop could could lead to a legal showdown that might make it easier to hold police accountable.   1. you all keep saying end qualified immunity, that's like asking firefighters to not wear protection. if society wants a bunch of cops waging war against drug users, they need qualified immunity. you can't cause a soft genocide against a miniority group and have accountability. the two are mutually exclusive. if you want to end qualified immunity, you must end the war.

  2. Is the license plate law actually about obscuring "information"? If every state has unique plates, how can you argue that 'information" has been obscured when even an illeterate person can identify a state's plate from the art?

  4. The police like to waste time doing nothing, they get paid a lot of money for doing nothing. That’s why they like to hang up the citizens. It also makes them feel powerful they need to feed their ego that’s one of the reasons they became a police officer in the first place. Power corrupts and it’s very easy for police officers to become corrupt with their power. Of course not all are so easily inclined. Some are just wonderful, just not enough.

"yes, your rights were violated, but there's never been a case where a person's rights have been violated in this way, so instead of diliberating an d creating more case law, I'm going to dismiss that charges everyone can see with a brain are legitimate, but because they haven't messed up in this specific way before I'm not going to change anything so it won't get better"… don't they see a fundamental problem with determining this based off of previous cases. Your are always dealing with new territory, requiring that ground be broken before is a built in handicap to bettering the system. It is ridiculous anyone could read that and support it. Are you serious? They have to violate your rights in the exact same way to be liable for it, well geez MR, I wonder if they just won't do it in a way that's been documented yet (they really don't understand how creative people are when they want to be)

  6. "We didn't know, we weren't acting in bad faith, etc" doesn't matter. You violated their rights. period. doesn't matter if you thought it was ok, what kind of defense is that? In good faith, in bad faith, you overstepped your bound and overreached the powers of your station. And yet they face no repercussions for the grievous acts against their fellow humans. Yes, trampling their rights in any way is grivous, once again, it doesn't matter if you thought it was ok or not. The courts hold that ignorance of the law is not an excuse for private citizens and yet those who enforce the law are given immunity when they are ignorant of it. Laws specify rights that are inherent to every person. So even if their were laws that went against the rights of the citizens, it would be the police's duty NOT to enforce that unjust law. Imagine how much farther ahead we'd be if the police didn't enfore jim crow laws. If they were actually willing to stand up for whats right.

"we have qualified immunity because it hasn't been explicitly stated that its a right" doesn't that bring into question a bigger problem of how these cases which are obvious rights violations are thrown out because of no legal precedent having been established already instead of themselves acting as the impetus for those precedents. How ridiculous to require a previous violation be referenced to argue yours have been violate now. And what of the new and creative ways those in power always seem to find ways of abusing others. Must you have every horrible thing happen before you nip it in the bud. This entire problem stems from the simple fact that they hold officials to a lower standards instead of a higher one. They should feel the full effects of their blunders, not be shielded from the consequences of their actions.

  8. so his defense for "i didn't know it was his right to record cops" is "i didn't know attempted vehicular manslaughter was bad either" … this person is a police officer and this is the standard of knowledge they are held to?

  9. "You can infringe rights if they aren't clearly established" what a ridiculous legal precedent. Quilified immunity is outrageous. If a police officer doesn't KNOW, then they shouldn't be enforcing it. You are dealing with peoples freedoms and rights, "oops, i thought I was right" isn't an excuse. They need to face legal repercussions for continuously being wrong in their enforcement of law. The fact that they get a cushion when they mess up instead of harsher punishment shows you explicitly the system is not designed to police itself. If that were the case, they would take these simple and obvious measures to prevent the continuing human rights violation that is qualified immunity. It shields them from the most destructive and most likely form of damage to occur. (it's likely, that's why they need qualified immunity? no. It's more likely so they need more training and harsher penalties when they misrepresent the law or "enforce laws" that don't exist). How is "I thought it was legal" not a defense but "I thought it was illegal" a complete defense for trampling people's rights.

  13. The Supreme Court ruled back in 1970 that cussing out a cop is free speech. But I've noticed that people are getting arrested all over America for speaking words. OMG. If the Supreme Court does not rule that you have free speech in this country there will be another Civil War. When people are silenced for their opinions it's time to revolt. I'm a 71-year old retired vet and I defended our freedom. I would rather die than be dominated. Remember "Masada." We refuse to be live under tyranny. The idea that there has to be an identical case IN THAT DISTRICT is ridiculous. If the Constitution is broken there doesn't have to be an identical case. Every single law in the United States has to conform to the Constitution.

After each ceremony to swear in new officers, there MUST be, these same officers, attending a classroom two hours later, for a test of knowledge, facts and process of the constitution and civil rights. Anyone who FAILS the test will be voided from any process for SIX months or beyond, until the next event scheduled for swearing in new officers. They should be unable to drive to another County, City or Town, the next week to apply anywhere until the SIX months minimum waiting period.

Even sinners, that say they would never let their beliefs interfere with their decisions, like supreme court judges, who are de facto evil sinners, that have broken every commandment of GOD, will in fact side with their beliefs. Every person that says otherwise is a liar! Fact: the supreme (evil men and women) court will not even uphold the law on illegals. Biden is king, so the courts do not get involved. The real SUPREME JUDGE IS COMING! He knows all your lies and secrets, and you will stand before Him and give account!
